Just so y’all know how much NIL $ Clemson players are getting compared to other teams.
Check out the attached.
I am not a fan of NIL in its present condition… it needs to be regulated or recruiting will turn into simply a bidding war. Even the NFL has salary caps and free agency rules. College football has no rules anymore… that’s why I no longer keep up with Clemson’s recruiting (or anyone else’s for that matter).

Current format of College Football is not sustainable.

No doubt, big changes coming up.

Gotta to NFL model with governance body at the top, rules and parameters. Parity will lead to better product on the field and more TV revenue which, unfortunately, is the glue that holds the business model together.

Hopefully something will be done sooner rather than later. My guess is nothing will be done until the whole landscape of college football changes to a different format. Only then will actual enforceable rules be put in place.

But we still can’t afford a $10 million dollar quarterback. Salary caps have to be put in place to keep it fair. Most teams still won’t be able to compete, but it won’t give the Texas teams free reign to buy anyone they want.

Not sure if you read my example of Home Depot paying Kirk Cousins? They certainly can, and maybe they do, but it has no influence on Kirk or any other player “transferring” to the Falcons because there are other totally legal ways of keeping players within their contract.
So, NIL CAN be regulated by implementing NFL rules. Not directly regulated, but it would no longer be a recruiting tool because recruiting wouldn’t exist.

It absolutely does, though. If Kirk Cousins knew he would $30M+ from the Falcons AND say an extra $10M from Home Depot where other places didn't have that offer, it does make a difference.

NFL has an antitrust exemption.
NCAA does not.

NFL athletes are employees.
NCAA athletes are not.

NFL is unionized with a contract.
NCAA is not and does not.

NFL has 32 teams.
Non military FBS has 131.

NFL has a draft.
NCAA does not.

The only similarity is that neither the NFL nor the NCAA can regulate private NIL.

So what you're saying is NCAA needs an anti-trust exemption.

Congress can and probably should pass a law that says something like

"Governing bodies for amateur athletics may set conditions for participation eligibility and to define amateur status for the governed sports. Voluntary participants in amateur athletics shall not be considered employees, and anti-trust and labor laws shall not apply."

the NCAA should be able to impose rules that must be followed in order to participate in NCAA sports.

But, the NCAA was correct in knowing for all those years that if you can pay an athlete at all for anything, then it results in them being paid to play. The only distinction is the accounting.

It is a salary. It’s an endorsement deal. Congress and the Senate are already looking at legislation which would make the 9th circuit court of California’s rulings moot. Judges cannot legislate from the bench. They only interpret. Her interpretation is bad.

Endorsers are not employees of the companies or NIL collectives fur which they advertise goods or services.

They are independent contractors.

The 9th circuit has nothing to do with it.
The Supreme Court and numerous other federal district courts do.

Congressional legislation? It failed in committee this year.

The next Congress is going to have much more important things in their plate than getting the NCAA an antitrust exemption. Even if they get it, it won't affect private NIL at all, because the NCAA can't legally interfere with business deals between two third parties.

See the huge numbers of pro athletes that make big NIL dollars from endorsement deals that the pro leagues can't regulate for the evidence.

I would say it proves the point. The top 5 have twice as much as we do. So they can afford to buy the elite players plus keep depth. Look at the current top 4 ranking then look at the list.

I’m under the assumption that the NIL $ will go way way down once the schools start paying the players and they become employees. Right now donors are ponying up big bucks to get players to their school. I hope this will change to what NIL is actually supposed to be for.

You are probably right that NIL can’t be regulated directly, just like there’s nothing to prevent Home Depot from giving Kirk Cousins a commercial deal. BUT, Home Depot has no influence on the Falcons ability to sign players or lure them from another team.
As I and many others have said, implement the NFL ( or any other professional league) rules and the importance of NIL will go away.

This is not a collective bargaining situation like MLB/MLBPA or NFL/NFLPA. This is a private entity (call it RHPLTMEG's LEMONADE STAND) deciding how much they want to give to an individual person. The Sherman Antitrust Act has been around since 1890.

The Interstate Commerce Act has been in the books since 1887.

The Supreme Court says the NCAA model is illegal. By a 9-0 vote in the Alston case.

Congress isn't going to change those laws, because without them the national economy would collapse.

Try to grasp the big picture. College sports are a drop in the bucket for what the pertinent laws cover.

Dabo is using the NIL $$$ we DO have to RETAIN players, which is why we don't foray into the Transfer Portal much, we don't have nearly as many guys leaving as some of the other "major" programs.

It is very easy to be a Monday Morning Quarterback, and say "We should just pony up the $$$ to sign Bubba Dubois and his $10 Million dollar NIL demands." If you have those $10 million just lying around, by all means, knock yourself out. Otherwise, maybe do like the spoon suggested, and shut the fork up?

NIL deals are not publicly reported so these are just guesses for clicks. ON3 for example just uses social media followers to estimate how much a player's NIL should be worth the aren't privy to any actual contracts or data.
