FSU has called out the flaws in the Grant of Rights stating that the ACC's "rights" to FSU's home games is contingent on ESPN's agreement with the ACC. Therefore the ACC's "rights" no longer matter if FSU is not in the ACC. The ACC was stating that they own all home broadcasts through 2036 regardless of broadcast. They are still arguing and clarifying.

Espn’s rights are dead if a member leaves (according to the FSU’s lawyer’s quote of the ACC lawyer). The GOR itself isn’t dead. ACC would still maintain those rights.

I'm not saying the GoR is dead but according to the ACC's interpretation, a school can be kicked out of the conference YET the ACC retains the broadcast right.
In what world does that make any sense?

FSU has argued that in the words of the ACC's own attorney, the ACC's "rights" to FSU home games is contingent on ESPN's agreement with the ACC. On that basis, the ACC's "rights" cease to exist if FSU is no longer a member of the ACC. If the judge agrees, and rules that ESPN's rights are dead if a member leaves, the ACC's case is sunk and the only thing to negotiate will be the $50 million exit penalty. A HUGE mistake by the ACC attorney.
