You sir are quite a bit out of your depth. The House settlement is DOA IMO and Title IX is one of many aspects that will get challenged in court. This is common knowledge to anyone with a legal education. Title IX has been law for 50 years and the DOE Fact Sheet issued yesterday is not law. Nor would a fact sheet issued by the next admin be law. The only news that one can derive from the latest DOE communication is we have more questions than answers at this point and you can be assured that this matter will be held up in courts for some time.

This could save college athletics. If the current plan holds 10 years from now the whole system will be gone due to financial failure . Clemson is making a giant mistake over paying coaches and athletes and the program in the long run will fail. The cable money and espn will all be cutting back. It is not substainable

The belief among some people that some coaches at Clemson (and many other universities) are overpaid cannot be ascertained at this point. All highly compensated employees in any organization may turn out to be overpaid, depending how the future financial realities for the organization match up with the original financial predictions.

There is always a reckoning for employees that are grossly overpaid … eventually. All salaried employees are compensated in advance in accordance to the value that the employer expects to get from the employee. This holds true even for the lowest level salaried workers; the worker is guaranteed his salary in advance for 2 weeks, whether or not his productivity at the end of that 2 week period justifies the originally agreed upon salary.

Dabo is paid handsomely right now for what the FB program anticipates getting (as far as ROI) in the future.

If it happens that Clemson’s FB program financial projections fall grossly short of its financial projections, then Dabo’s current salary won’t be re-upped.

This is how the self-corrective mechanism of a business works.

then the courts eventually will. The problem for this DOE memo is that it categorizes the athlete payments as "athletic financial assistance" which is decidedly not what these payments are.

The courts have specifically ruled that these payments are "compensation" for these athletes participation in revenue generation and not some form of "financial aid/assistance". The power hungry bureaucrats at the DOE are trying to insert themselves into a process of which they have no legal authority and will get smoked if taken to trial....

Hopefully this is quickly corrected by the incoming administration and avoids having to clog up our courts with this nonsense.

to do it fairly, it should be proportioned based on total revenue that sports brings in, not not evenly split. Heard a million times, if women want to make money in sports, they need more people to show up for the games, and that is not the case. It is simply free market economics.

There is absolutely no doubt that Civil Rights attorneys are lining up with supporters of Title IX and the notion of 80% or so of the money going to football was never going to work. What I can see is schools taking part of the money and distributing it to all athletes and then putting the bulk into a Collective to be used for market based NIL money. In 2025, it is just unrealistic that women athletes and non revenue athletes will not receive their share because the laws of discrimination will be challenged from the word go.

It supports what I've been saying about the NIL clause in the House case.

The NCAA can't interfere in private NIL because it's an illegal limit on what people can earn.

The NCAA has three, maybe four choices.

1. Proceed with the settlement but drop the NIL/clearinghouse clause and take their chances with the Title IX issues. That could hurt every FBS football program.

2. Cancel the settlement and take their chances with litigation. That's likely organizational suicide for the NCAA. No telling what the ripple effects of that would be.

3. Continue to lobby Congress for an ATE. No signs that will get enough vires to pass. Even if it does, it is very unlikely it will have any effect on NIL.

4. Least likely - CFB becomes paid employees or contractors with no student requirement and no NIL cap. That eliminates the bulk of the Title IX problems, creates jobs, and keeps the bulk of the money with the people that create the demand - the football teams.

I'm no expert, but I can think of a chilling effect of this. Could a school with low sports revenue, take $20M from general funds (i.e. academic funds) to try to build their program into something equal to major schools, like ACC or SEC? Could South Carolina State buy a top 20 basketball team, which would hopefully produce good sports revenue? I'm not worried about small schools getting better, but about students that go to a university for academics, not to play games. Will you and me and our children get what they pay for? Will tuition go up to subsidize guys that are only at school to play sports? I sure hope there's a plan to not let this happen. That money better come solely from athletic revenue, or rich alums paying for sports.
