Not a huge deal, in practice they lean towards a fair catch for player safety. He's proven he can do it now. He needs to be a threat going forward.

Read the next rule down.

Technically we caught a little break, because it was an invalid signal, which is actually a 5 yard penalty.

He certainly made a clear signaling motion, and we actually got the benefit of the doubt that it was valid.

but they also define an "invalid signal", and there's this from earlier in the book--

c. A valid or invalid fair catch signal deprives the receiving team of the opportunity to advance the ball. The ball is declared dead at the spot of the catch or recovery.

Nope. It’s called very conservatively and always has been. You don’t literally have to put your hand over your head and wave it side to side. Brown clearly signaled for a fair catch, unfortunately, because they was a heck of a return.

It was not a valid fair catch signal. Also, if it was a fair catch, we should have been penalized for advancing the ball.

They only penalize you if they think you are doing it intentionally to use it for your gain. If they think the player does it unintentionally, it’s never a penalty.

You're right in one way, it wasn't a *valid* fair catch signal, but it was a signalling motion and that will (or should) stop the play every time. It actually should've been a 5 yard penalty for an invalid signal.
