Any updates on this?

He was charged with unlawful possession of a firearm on university property.

"According to the Pickens County court records, the redshirt senior was arrested on a weapons charge for "carrying or displaying firearms (on) school property" and a traffic charge for "failure to exercise due care while operating a motor vehicle."

"The Greenville News obtained the incident report from the Clemson University police. He was observed a vehicle spinning his tires and accelerating quickly twice after 8 p.m., which caused the traffic stop in the Duckworth Family Tennis Facility parking lot."

I can understand him being pulled if acting out in his car (my VW could not spin tires, but saw those who could as fun when that age). Everyone who breaks auto laws should be made to pay as that effects us all. Spinning tires aint a big deal like speeding, DUI, etc, write a ticket and move on.

The gun was locked in his trunk. Guns on Campus are not legal, but I may or may not have gone in that same area often with one as do thousands. The vehicle he was driving is not owned by him.
This reminds me of a case where a friend's 17 year old daughter drove his car to school and a kid saw a gun in the trunk she did not know was there. She was an all "A" student, her Pop was a Cop. She was kicked out. Each case is different, no one rule fits all -> that was wrong.

The Cops were right. The kid broke the law. The laws need adjusting. This in no way should affect this kid's football/etc life.

Sounds like he was being stupid.

According to the CUPD report, obtained by The State via public records request, Capehart was initially stopped by university police on Feb. 6, 2024, around 8:17 p.m. for spinning the car’s tires and accelerating to a “high rate of speed” in a 25 mph zone on campus in a 2021 Dodge Charger.

Why did the police officer ask to search the car for a traffic ticket? There was absolutely no reason to search the car for a traffic violation!

Cops ask, and in this case he agreed as he believed nothing was amiss.
The bullets in the glove box are not probable cause to search.

During a traffic stop conducted in the parking lot of Clemson’s tennis facility at 188 Old Greenville Highway, an officer wrote that “while searching for his vehicle information, Capehart opened his glove box, revealing a loaded magazine with what appeared to be small caliber rounds” for a firearm, according to the police report.

Maybe he picked up others trash or some drank them while parked. He was not charged with DUI or even open container.

You are correct about no DUI or open container charges. My guess is that they had been there a while. I "heard" this may be resolved very soon due to his cooperation.

He had a magazine in the glove box when he reached to get his registration according to the article after telling them he didn’t have a gun, etc.

The law, as opposed to right and wrong or public opinion, is different. We are a nation of law (not really but we claim that). Bullets in your glove box do not violate any law in SC.

An officer who sees, hears, or smells something suspicious during a traffic stop can search the car—without a warrant. For instance, if the officer sees a baggie containing white powder in the back seat, the officer would likely have probable cause that illegal drugs are in the vehicle.

ammo and a loaded magazine. A loaded magazine is a much stronger indicator that there's a firearm in the vehicle than a box of ammo or a few loose rounds.

When I attended the 90s, there was no need to carry, I can not see how that has changed for your average student unless you are a girl who has to walk alone at night on campus.

Fast forward to players being handed huge endorsement deals and driving around in expensive cars and fancy jewelry, and it is only fair to assume this would make them targets, probably more so in their hometowns than on campus. But Criminals follow the money, and right now a lot of money is flowing onto our campuses. It is sad our players feel the need to pack, it is only a matter of time before something bad happens. And I would be curious to see if crime has risen on college campuses since NIL was instituted, I would assume that it would eventually.

A large dude.....in a Dodge Charger that is not yours.... doing minor stunts.....in a Southern town.... with a gun involved whether its his or not. Its the ingredients of a bad recipe for problems he don't want. Dabo was definitely his saving grace in this one... because it could have been so much worse for Capehart.

Are we talking the cops are rednecks or just trying to do their job protecting the public from large DE’s with guns an ammunition doing spin outs in areas students walk frequently?

I hope he gets this settled and has an All-American season for Clemson setting himself up for getting drafted in the top 4 rounds of the NFL draft.

I was joking about the redneck part because all of us no matter our color or nationality from the south(SC, Ga or NC) are considered rednecks by those from outside the area. I’m proud to be a redneck in that respect!

Tug, the moral of this story is never freely offer any information to a cop. The do not have the right to search your vehicle. They will always ask you, do you mind if I search your car? Never grant them permission because they then can go on a fishing expedition. You never know, the clown you thought was your friend could have left his stash tucked down in your seat until he could retrieve it. You then become liable. Make them get a warrant.

Remember every time you round a corner and come upon a police road block for a supposed license check, they are up to no good. It is a violation of the 4th Amendment. JMO
