Sorry for long post, this is directly from the IPTAY website. Just want clarification if anyone has some.

“Universities would be permitted to directly share revenues with student-athletes in addition to the benefits that already accompany scholarships: tuition, housing, meals, academic awards, health care, etc. The settlement sets a uniform revenue share cap for all A5 schools equal to 22% of the average media, ticket, and sponsorship revenue. For 2025-26 the revenue share cap for each school is approximately $20.5M and will be periodically recalculated. Each individual school can decide how to distribute the revenue share amongst its sports teams and student-athletes. There is no minimum required distribution. The revenue share is associated with the grant of certain NIL rights to the school and does not create an employment relationship between the school and its student-athletes.

The settlement also allows for third-party NIL payments to student-athletes. Those third-party payments must be fair market value payments for a legitimate business purpose and not used for pay-for-play (e.g., merely an inducement to enroll or remain at a particular institution.) Legitimate third-party NIL payments will not count towards the revenue share cap and will be reviewed by an independent clearing house to determine compliance with the fair market value rules. This will be a fundamental shift in the current NIL landscape where there is currently no legitimate purpose / fair market value requirement. These rules are in the process of being written.”

Does this not mean that a situation like Dave Portnoy and Barstool “luring” Bryce Underwood to Michigan over LSU becomes rule breaking? It certainly reads that way.

They can use the collective right now to do what Michigan did before this Rev share goes into play. Which is why you’re going to see schools throw piles of money at players before this goes into effect.

I think it *should* read that way, but I have a feeling it's going to be hard to truly police it. It used to be fairly obvious which players were getting paid under the table (what they wear on road trips, cars, etc) but with them being able to collect large sums of money already, those can be covered with "legitimate" NIL money while they keep the Portnoy-style payments under the table. I just don't see how the teams that are already known to do so much under the table stuff will stop; it'll just be tougher to catch (not that the NCAA really has the stones to police things anymore as it is). Maybe I'm just jaded. Also...how do we determine "fair market value?" It turns into "Underwood does an advertisement for Barstool and gets paid X dollars." Who determines what X is? NCAA? Michigan? Big10? Portnoy? I have a lot of questions in that realm.

Beyond policing it, it will be enforceable without an antitrust exemption. Every effort to constrain payments to players has been rejected by the courts and this one will too.

To appear on a couple podcasts seems to be a bit outrageous & certainly not “fair market value.” Only Michigan will ever have access to barstool money. Only Oregon will have access to Nike money. That just seems incredibly unfair. But then again, I think this whole thing is just the Wild West and not sure how anything will change. Regardless, I’m not sure how any person can think Clemson would be able to pony up that much money through an NIL collective for one player.

Market is what someone is willing to pay for a good or service.

Portnoy could very well make the case that paying that QB 2.3 mil a year for appearances among other obligations would be an ROI for his company.

Though barstool could argue Underwood’s ROI is there, if the deal is only given on the basis he attends Michigan, that would violate the rules as pay for play. But, I am unsure how the third party entity could ask that question to barstool, or any collective for that matter, & not expect to be lied to. “Of course we would still give this money if he chose any other school.”

Maybe those types of deals will be denied if the company is too closely tied to a university.

.... who is the "third party" that decides what is fair market value and what are the penalties for violating fair market value. If this third party is as effective as the NCAA is in dealing with recruiting violations and the Michigan sign stealing fiasco, then we will be operating under "business as usual."

Fair market value is what someone is willing to pay. If someone is willing to pay a CFB athlete $3 mil per year to sell a few jerseys, then that's fair market value.

Those two schools are the ones that can throw serious money at players. Since they are not in the mighty SEC, ESPN has incentive to have this mess fixed.

Clemson will not violate rules with Dabo as head of our program. Those who feel winning is a must at any cost will need to dispose of Dabo to be satisfied.

I now declare here before all: I shall never call for Dabo's dismissal unless he undergoes radical changes of the heart. I do so pray that his resolve toward honesty and integrity remains immutable.

It's unlikely to withstand them.

That clause conflicts with the injunction in the Tennessee vs NCAA case as well.
That conflict is probably headed to a higher court.
