1. All players sign contracts as members of a NCAA player's collective. They must return any NIL money if they con't complete the term of their contract. Also players must remain academically eligible.

2. Bring back one year sit-out for transferring. No exceptions except if a coach leaves or a school is hit with sanctions or gets blown up or something.

3. "Salary Caps" for teams based on conference affiliation.

4. 5% of coaches salaries go to the "Jimmy and Joes NIL" fun to be shared equally among all players.

5. 5% of conference distributions to schools go directly to players, split evenly.


This way... contract law makes this thing stick and avoids the NCAA losing in court over and over. Players are heavily disincentivized from transferring, which is the only real sport-breaking problem right now. The money players get is more formalized, standardized, and (slightly) evenly distributed. Conferences and institutions have to lead this charge. The NCAA is dead in the water.

different sources to form an opinion - right left and international viewpoints. For the right side, I read WSJ, Fox and Elon Musk. It doesn't make me better than anyone, but it does help me stay somewhat informed and try to stay away from getting swept up in a wave of propaganda from any single source or side.

We all have our ways to try and be educated citizens, that's just mine.

1. Illegal under federal law. Sherman Antitrust Act violation. Violates NCAA vs Alston and Tennessee/Virginia vs NCAA.

2. Illegal. Sherman Antitrust Act violation.
Interstate Commerce Act violation if the transfer is across a state line. Violates Ohio vs NCAA.

3. There is no salary cap on NIL. Same legal basis as #1.

4. Never going to happen. It would violate every coaching contract in the USA.

5. Moot. Each school will be able to direct up to around $22 million in revenue sharing to athletes next year.

Completely unworkable.

It takes Congress passing a bill to get it.
Tommy Tuberville (R-AL) tried last year.
He couldn't get his draft bill out of committee. The general feeling I get was that there is no interest in doing something that will continue the wrongs of the old NCAA system.

Only pro sports get AT exemptions, and not all of them do. In order to get one, it takes a completely professional, single league,
athletes paid fair market value, player unions and collective bargaining, union contracts, and the right to strike.

Those things are a pretty clear different set of circumstances than pro sports.

Lots more divergent interests in college sports, for one thing. I think that's why the BIG and the SEC. If they form a NFL sized super league, they can cut ties with the NCAA and form a model that is legal, more profitable, and more sustainable.

The downside? It's going to suck for everybody else, including Clemson.

Bluff,

I generally agree with your post, but it seems that more people in Congress might be willing to consider anti-trust legislation after considering that their state schools are going to be among the ones fuckedover by the way things seem to be headed with the SEC and the BIG.

Of course, it would take some adaptations to work with college programs, but modified fair market value, player unions and collective bargaining, union contracts, and the right to strike sounds better to me (and for college football) than all of the collateral damage that will be caused by a superleague.

If they get their way to dominate the NCAA, then an antitrust exe option actually helps them and hurts everyone else.

If they split from the NCAA, they can argue that's evidence of free market competition so no anti trust exemption is needed.

Anti trust exemptions apply to the entire entity, not just employer/employee relations.

Agreed. The judge has already laid out the basics. The final wording is going to change it some. She was adamant that limiting earning potential and taking back NIL money will not happen. Just read the legal briefs people. College football is not ever going to be what it was.

There is no federal case that invalidates contract law. Anyone can form a collective and enter freely into a contract. The NCAA cases do not involve contracts.

Again, illegal contracts are not enforceable in ANY circumstances. Any attempt by the NCAA to interfere with it or regulate private NIL is illegal. Period.

They can't interfere in a contract between two other private entities. For all of you repeating "contract law", you should know that.

In fact, I've said things are working just fine in terms of attendance, TV viewership, and money.

There isn't going to be collective bargaining without the athletes getting employee status. That's not going to happen until the Dartmouth basketball team case is decided.

Football wokd and ungoverned? It's not that now. It's governed by state and federal law and by market forces.

There are multiple federal laws that invalidate illegal contracts as cited above.
If you're right, then Mafia hit contracts are legal.

So when it comes to the original intent of the NIL, you are absolutely right. And nobody should regulate that. Players should be allowed to make unlimited money from whatever advertisers in the free market bid for based on supply and demand.

But what NIL actually is now, is a disingenuously packaged offer, unofficially attached to football programs, that amount to pay for play, without the benefit of an actual legal contract. It's wide open and extremely easy to leave one or all parties unsatisfied.

So when I say a cap on NIL, I should have said a cap on pay for play. NFL players don't rely on endorsements to get paid. They are an extra benefit. The richer programs have co-opted this as an ad-hoc pay for play. This mixed with the current version of the transfer portal has made things wild. Thankfully many programs have been burned by their over-use. But an excess of money doesn't learn lessons like budgeted money.

Federal laws override any contract that violates them.

That includes anything that falls under antitrust violations, interstate commerce violations, or RICO, among other things.

The NCAA blatantly and repeatedly did two of those things. There seriously close to RICO charges of they keep doing it.

They stopped doing it, except for trying to sneak in a clause in the House vs NCAA case. That settlement got tabled because
that clause is not only an antitrust violation, it violates the NCAA vs Alston and TN/VA vs NCAA judicial decisions.

You don't even know what any of those cases are, do you?

The NCAA can't regulate, interfere with, or limit transfers in any way.

#5 isn't going to fly, either.

Revenue sharing starts next year.
Each school decides how to split it up.
There is no direct relationship between the athletes revenue sharing and coaches salaries or a percentage thereof.

We have what we have unless the NCAA gets a federal antitrust exemption.

Congress has shown zero interest in that.
Senator Timmy Tuberville (R-AL) tried.
He couldn't even get his draft bill out of committee.

That’s a pipe dream. The judge overseeing NIL wording has already said zero restrictions on NIL monies earned. Giving back earned money was one of her sticking points. Great ideas, just not realistic.

I like your ideas but am confused by your last comment about the schools leading as the NCAA is dead in the water. Note the board of governors for the NCAA is made up of leaders from various schools so the schools control the NCAA.
