WASHINGTON, Oct 24 (Reuters) - Another former lawyer for Donald Trump, Jenna Ellis, pleaded guilty on Tuesday to a charge related to the former U.S. president's efforts to overturn his 2020 election defeat in the state of Georgia.

Ellis, told an Atlanta court that she "failed to do my due diligence" in vetting claims about voter fraud from other Trump attorneys.

“If I knew then what I knew now, I would have declined to represent Donald Trump in these post-challenges." Ellis said, her voice breaking at times.

"What I did not do and should have done, your honor, was to make sure that the facts the other lawyers alleged to be true were in fact true," Ellis told Fulton County Superior Court Judge Scott McAfee. "I look back on this whole experience with deep remorse."

So let me get this straight - There were what 25-30 felonies that were dismissed for a couple of misdemeanors so far - this is a win?

For starters, the cost of defense is huge - that alone is worth a plea

Don't get too excited to get MAGA in court - He will finally have the power to introduce evidence and subpoena witnesses.

Ellis and Chesebro both pleaded to felonies. Disbarrment, loss of civil rights (especially guns), and limits on travel while on probation. But they avoid jail time.

Hall and Powell went first and second and got misdemeanors. Might be the last without felonies. Not sure when the first prison sentence is coming, or how Georgia is going to handle sentencing Trump to confinement. Best guess is house arrest to accommodate the secret service, but he’ll have to live in Georgia.

These pleas by Chesborough and Ellis were an administrative formality.

Under GA’s ‘First Offender’ law, the actual final judgement did not contain any reference to a felony.

Chesborough got 5 years probation, after which (assuming he doesn’t start shooting up liquor stores) all record of the indictment and plea deal will be expunged.

Same thing with Ellis, except that her probation is 3 years.

(?). I keep hearing from the leftist media (I also occasionally look at lefty blogs like Legal Eagle) that Trump’s lawyers and those co-indictees are stupid.

Maybe so.

However, why is it that they keep waxing the floor with the various prosecutors who had brought indictments against him / his co-indictees? It must be terribly embarrassing for the federal / state government’s super genius prosecutors to be repeatedly shamed for poor lawyering vis-a-vis Trump’s idiot lawyers.

Andrew Weissman (one of many big time lawyers who hates Trump) warned exuberant Trump haters to calm down about the Powell and Chesborough judgements. (Weissman’s comments came out before the J.Ellis judgement.) Weissman’s comments took into account the gratuitous ‘Orange Man Bad apology letters’ which were one of the conditions in which Powell, Chesborough, and later Ellis had to fulfill in order to secure their final cream puff judgements.

(*). Unless someone credibly testifies that they were privy to Trump stating that he knew he lost the election, but decided to publicly state otherwise (I.e., to say publicly that he won the election after confiding to one or more among Powell / Chesborough / Ellis / etc. that he knew that he had legitimately lost the election), then the witnesses testimony will not hold up.

Trump had / has no requirement to adopt the opinions and beliefs of others. Many people have truly believed something that others did not believe. Sometimes that single person’s belief turns out to be correct; sometimes that single person’s beliefs turn out to be wrong; sometimes that single person’s beliefs can neither be proven or disproven vis-a-vis the other people’s beliefs.

It does not matter if the beliefs of the single person turn out to be true, false, or indeterminate. The entirety of a fraud allegation hinges in whether the person expressing his belief was done so sincerely, or done with the intention to deceive. Powell, Chesborough, Ellis, Meadows, Giuliani, etc. know this. Any testimony along the lines of ‘we told Trump,that he lost’ mean nothing UNLESS Trump expressed unambiguous agreement with them.

I suspect the above is why Weissman advised his fellow Trump,haters to splash some cold after on their faces.

(*). The loss that GA and Fani Willis are facing is to get neither Trump -nor- any of his so called ‘RICO’ co-conspirators. In other words, not even any ‘consolation prizes.’ A big goose egg, since State of Georgia has in effect let off the Trump ‘co-conspirators’ free as birds.

You don't understand how it works. He pleaded guilty to a felony, period. Under the first offender laws, the record of his felony is only removed from searches we, as citizens, can make. He will still be a felon; it doesn't make him retroactively not guilty. He only gets one "first time," so the record is still there for the courts and law enforcement to see. If he commits another felony in five or ten years, it will be his second felony.

As a felon, the only way he can regain all of his civil rights is through a presidential pardon. Neither the first offender law or a governor's pardon will restore his gun rights.

Chesborough’s final plea document was watered down under State of GA’s ‘First Offender’ law.

Assuming that he doesn’t violate the terms of his probation, all record of his plea will be expunged from the record.

No jail, token fines totaling ~ $7,700.

Seeetheart last minute plea deal offered by a desperate prosecution team.

Untruthful testimony could be either favorable or unfavorable for Trump’s cause in the case.

Part of the plea deal / final judgement was to not provide false testimony.

Had the prosecution held the specter of jail time or other harsh punishments over the potential witnesses, then the witnesses might have decided to risk providing unfavorable testimony against Trump because they knew that this is what the prosecution wants.

Now, if the witnesses provide honest testimony that doesn’t end up creating the conditions to convict Trump, it will be up to the prosecution to PROVE that the witnesses were untruthful in their testimony. That is a far higher hurdle, since the easily invoked coercion variable has been removed from the prosecution’s order of battle.

In other words, had the prosecution been able to win a plea deal that involved jail time, then the prosecution could easily assert that the witness did not testify according to expectations, and so off to jail they’d go.

(*). The State of GA prosecution lost big time with their weak plea deals to Trump’s aides.

Each one of them has provided video statements of what they are willing to testify to, and then been interviewed by the prosecution. The full truth is out there, they just need witnesses to help prove it.

Trump’s only defense is that he’s a moron who thought he really won the election. And even that’s not enough to clear him. Easy felony conviction for even the worst prosecutor. Let his cult go on another rampage, police are ready this time.

Jenna Ellis embarrassed thoroughly embarrassed herself.

She still got the win, though, via the tremendous last minute sweetheart deal. I don’t blame her, as a young and inexperienced lawyer, being badly scared about being sent to a women’s prison with gang bangers wearing women’s’ garb as her neighbors on cell block C.

The State of GA prosecution team was obviously not ready for trial with these ‘fast and speedy trial’ requests from each of Powell, Chesborough, and Ellis. State of GA gave away too much, even though State of GA is wrong with their indictments. Had State of GA been prepared, then they could have wielded the Lawfare hammer to wrongly convict these people. State of GA got thoroughly out-lawyered here.
