Just maybe the university owns the media rights? At least that is what the Supreme Court said in 1984 (UGA and OK verses NCAA). The ruling, in favor of UGA and OK was 7 - 2, and based on NCAA anti-trust violation. If Clemson gets a better deal, can the university accept the new deal without penalty?
I will be having a discussion with a NYC Business and Contract attorney in early June to see what his opinion is.

No the Supreme Court case from 1984 is not applicable here. That was an antitrust case. A grain of Rights agreement is not going to be antitrust. This is just a dispute cause one party doesn't like how the contract is turned out years after the fact. So basically no Clemson can't get out of the rights without the penalty. I mean people are just engaging in a lot of wishful thinking on this topic.

Evidently tdq is a lawyer, because everyone is wrong except for him. What he don’t realize is, these lawsuits will be settled, thus we will NOT be waiting on a judge’s decision. Wonder if he will admit being wrong? Probably not, will come up with some lame assss excuse…lol

But seriously, I don't think Clemson or FSU believes they will get out of the contract with no penalty but they are trying to force the ACC into negotiations to avoid a nasty court battle that will include a bunch of discovery

BS argument. Until the last two years the ACC agreement with ESPN was equitable and in line with other conferences. With the astronomical differences in payout and the ever changing landscape of college sports the current agreement no longer is competitive. Clemson's filing is for clarification on the grant of rights is Clemson leaves the ACC and the punitive buyout.

Hard to say but I believe the buyout should be in the $25 to $50 million range. I also believe with all the clarifications of the GoR asked for, Clemson is trying to force the ACC to put an actual value on Clemson's media rights through 2036 and take the appropriate actions from there.
Next, will ESecPN renew the TV contract with the ACC in 2027? I know the ACC is cheap compared to the SEC but what ACC value there is, is being driven by a handful of schools. The question is whether ESecPN can make more money if the top ACC schools move to the SEC? (This is where it gets tricky for the ACC to value Clemson publicly). If ESecPN can make more money with Clemson, UNC, FSU and one other school in the SEC, then, bye, bye ACCN.

Believe what you want...its been out there....maybe you haven't looked. Its been discussed on here a bit over past two years...maybe you weren't paying attention...(no offense). CLEM and FSU have been on this FOR YEARS....
Or maybe others know more.......

Why would ESPN pay pay more for Clemson in the SEC when they can get Clemson et al for less in the ACC.

Because Clemson and FSU drive the conference. They could move both to the SEC and pay them more and not renew the ACC contract and save a ton.

Not sure how that is "interesting". They are just performing their fiduciary duties as board members. Of course they allocated time to review these items. That is a baseline function of their jobs.
