I see the NIL deals over $600 will have to be reported to rhe school. Do you think this will be made public? Or will this only be between the school and player?

Folks who are paying NIL monies to players are not going to play the $599 payments multiple times. CPA firms and IRS gets real excited when they run across this type activity.

You obviously no far more about the legalities of all this stuff than I do.

In your opinion will this be legal?

Could the NFL, if they so chose, require Patrick Mahomes to disclose how much he is being paid by State Farm (just as one example)?

Somehow, I don't think that would be legal, unless is was negotiated through collective bargaining and agreed to by both parties.

I’m not sure it really matters. They can always sharpen the pencils and the back door deals will be what they currently are. Legal NIL’s are the least of the current issues plaguing this sport. With no real governing body it is get yours however your school can make it happen.
And yes I do not for one minute think the schools are not involved in some fashion. When a coach can say they need 20 mill to do business something is wrong.

NBA teams have used this tactic for years. "Why do you want to play for the Timberwolves? Sure, they will pay you as much money as we will. But, do you know how much more money you can make in the Los Angeles market than you can make in Minneapolis?"

The judge has concerns that the NIL component is a Sherman Antitrust Act violation.

The athletes and their attorneys are very unlikely to accept it.

It also conflicts with parts of the SCOTUS ruling in NCAA vs Alston and the restraining order in the Tennessee/Virginia vs NCAA case.

The judge doesn't think that the NCAA NIL clause should be included. The NCAA is trying to keep it in. If that happens, the athletes will likely refuse to settle and go to trial. That may out the NCAA on the hook for far more than the 2.76 billion that's been proposed if the athletes win at trial.

The athlete win us probable in that case.
It's the only reason the NCAA would have agreed to the astronomical settlement number.

There's another issue with this. This case involves FORMER athletes. It's bogus for the NCAA to try to use it against current and future athletes.

My stance is, "NCAA you made your bed. Now, sleep in it."

Or: When you sleep with dogs, you wake up with fleas.

Or: When you wrestle with pigs, you get muddy.

It's the law of unintended consequences. NCAA wants to be a very lucrative minor league for the NBA and NFL. They want to be THE ONLY minor league for those two leagues. They have worked very hard to ensure they are the only realistic path for a kid to go from HS to the NBA or NFL.

So, the judge is telling them, "You want to be a very lucrative professional sports organization. Great. Now, follow the rules of professional sports organizations."

My comment is: NCAA, you made you bed. Now sleep in it.
