See Plessy v Ferguson then Brown vs Board of Education.... By the way it was largely the same SCOTUS that ruled segregation was Constitutional as did the United States v. Wong Kim Ark case.

Point being - issues can get a relook at any time and change. I find it hard to believe that when the States and Congress passed the 14th Amendment in 1866 that they intended for US citizenship to be so open that birth tourism would be acceptable in gaining US Citizenship. Truth be told the 14th Amendment was passed during reconstruction to protect former Slaves from being denied rights.

The "birthright citizenship" portion of 14th Amendment needs a present day adjudication by the SCOTUS where it can consider how it is being applied today. Let both sides of the issue argue a position and have the SCOTUS rule on it. From whatever comes of the SCOTUS decision - Congress and the States can then decide if they want to do anything to change that outcome or not.

Of course that wasn't the original intent of the 14th amendment until suddenly it was. Now it's treated as the gospel by people who welcome alien invaders with open arms and free housing, medical care and EBT cards. Imagine that.

No way to get the SC to make a decision on this otherwise, so this isn't unexpected nor will the left suing to stop many other of his EOs be unexpected. Don't think there's a high likelihood of the SC deciding birthright citizenship suddenly isn't a thing but anything Trump can do to let pregnant illegals know they aren't welcome here is welcomed. There's absolutely no upside to our society paying for a pregnant female to give birth and raise a child here on the govt dole no matter how many egg head jurists claim its right there in the Constitution and that we have to embrace it happening.

that's not how laws and the legal system work.

The order is clearly unconstitutional as the judge points out. Getting it to the SCOTUS isn't going to change that.

if an illegal commits a crime in the US, are they not subject to the jurisdiction of United States court system?

The lawyer for the admin agreed they were and OF COURSE they are.

Again, no one with any sense is going to interpret that clause to say they aren't.
