The Kirby Law , it seems, is at nearly every university now. I can't believe that a university has any right to step Into law matters esp when a person is hurt. Mentioned something about handling misdemeanord from a ''university standpoint". Sure man. So does that mean that if a player is picked up for let's say petit larceny or malicious damage, simple assault, all go through the university's punishment as opposed to judicial or magistrate penalties? Wow
That's not fair to the criminal or the victim. And we see here that I. This case it didn't work out I'm guessing Ms Alvarez found some ##### that wants to take a car wreck to civil court and sue for emotional and physical damage and shyt. Wow
My question is how much does a lawyer expect to get from two college students? Lol ###

Um, charged with a misdemeanor by civilian authorities and then faced internal discipline with school/football team. This is a civil case. Three separate issues.

The internal punishments are darn near irrelevant. Whether a player gets benched or kicked off the team or given a Heisman trophy shouldn't mean squat vs. what the legal system should have in store.
The legal punishments for street racing, however, are currently too lax.
The criminal component needs to statutory consequences similar to that of DWI / DUI.
After defining what level of exceeding speed limit is considered to be 'street racing,' then the minimum punishments need to be dramatically increased.
First instance (if no harm to others): 5 days in jail + 6 month suspension of DL.
First instance (if harm to others occurred): 30 days in jail + 3 year suspension of drivers license.
Second instance (if no harm to others): 10 days in jail + 1 year suspension of DL.
Second instance (if harm to others happened after no harm to others in 1st instance): 1 year in jail + 5 year suspension of DL + vehicle is seized (whether owned by the driver, or by a relative or friend).
Second instance (if harm to others happened after there was harm to others in 1st instance): 5 years in jail + permanent suspension of DL + vehicle is seized (whether owned by the driver, or by a relative or friend).
Bad actions should result in bad consequences.

Not sure what you’re even saying. Fred charged with reckless driving (the most serious charge available since luckily the lady did not die). In addition to that, the team/school punished him. Happens regularly, even for non athletes. Get a DUI and college can require substance abuse counseling, put you on probation, etc IN ADDITION to whatever the government gives you on the criminal side.
As for civil suit, I’d bet she’s trying to get both of the players insurance $ and also some underinsured coverage she probably had on her own vehicle.

She has to file the lawsuit to get whatever insurance the players may have. As for them personally, if the lawsuit is not settled, they will just file bankruptcy before signing an NFL contract, if they get one.

They were racing probably the other driver wasn't involved in the accident. Going twice the speed limit but should have been arrested for felony attempted murder for racing like that.

Nothing is going to happen playing-time wise; if either player misses time, it won’t be because of this. This issue has already been handled internally last year, the lawsuit is honestly just a formality. Their insurance will handle it and they’ll probably never even see the court room.

Yes, she’s suing to collect whatever liability insurance those guys had, and could be looking for underinsured coverage from her own personal policy (even if not in her personal vehicle). She’s also probably going to get worker’s compensation from the federal system also as she was injured at work.
Sad all the way around. Hope there is a lot of coverage out there for her to get. Hope those guys learned something also.

I'm not a lawyer but have worked in the legal industry for many years. While I'm not 100% sure, in some cases where there is such a gross neglect a judge can allow a plaintiff to sue individuals personally in addition to their covered liability. I am thinking that the plaintiff has sued the insurance company covering Davis based on the traffic accident and is now attempting to go after both Davis and Greene personally due to the gross neglect.

If he ends up making money as a pro between now and a settlement/verdict, and her injuries are bad enough, he may end up paying some out of pocket money, in addition to insurance money. I’m ok with that. Such a terrible choice that has serious consequences.

that hopefully some young kids will learn the reality of a speeding car's impact potential.
When I was a kid, two teenagers were killed as a result of their speed and the cops put their terribly mangled car on display for all the kids of the town to see. I know at least one kid it made an impression on. Too bad that same sort of lesson couldn't be done in today's sissified world.
This crash is tragic for the woman and tragic for the two players. Everybody loses.

It’s tragic for the woman. Not tragic for Davis. He chose to drive like an irresponsible fool and now should pay dearly for it. The woman’s life has been permanently changed by his foolish actions. You don’t have to be a rocket scientist to know how dangerous it is to drive 115 under any conditions let alone with other people on the road. His actions show he cares about no one but himself and now he has to deal with the consequences which should be steep in my eyes. I would be so pissed off if that was my mother he hit. I’d be going after every last penny he had. He should be off the team. Very disappointed

The problem is this case is that the mistake caused permanent damage to another person. You can't just say "kids do dumb things" and shrug you shoulders on this one.

It doesn't matter how sorry a parent or guardian or sibling feels about the consequences that a young family member faces for profoundly irresponsible and dangerous-to-others behavior.
