In other news, Trump / classified docs case has been dismissed

To anyone that has seen the (very belatedly) unredacted transcripts of the investigative & prosecutorial team’s activities, this ruling to dismiss the case is obviously correct.
The Soecial Prosecutor in this case was also deemed to not have been legally appointed. This is a huge black eye for former SCOTUS nominee and current AG Merrick Garland.

Yeah…can this be appealed and overseen by another judge? If not, I guess Cannon proved her loyalty to the Orange God-King. This case was doomed from the start, but not because it didn’t have merit.

Yes. It will be appealed and overturned at the appellate level. SCOTUS will have a tough decision, but it will have to wait until the next term. By that point, Trump may have already pardoned himself. He can tell DOJ to dismiss, but I don't think he's stupid enough not to pardon himself this time.

The deterioration of the prosecution’s case took place gradually, and then suddenly.
In the original indictment, the prosecution (Jack Smith’s team) delayed producing materials that the defense had requested as being potentially exculpatory evidence. The prosecution insisted that all potentially exculpatory materials had been provided to Trump’s team, and had even provided tabs and sequence information to assist Trump’s team to expeditiously prepare their defense. Judge Cannon went along with this as a something like a conditional decision, but left the door ajar for further considerations on behalf of the defense.
There were a series of motions and counter-motions filed over the ensuing few months. This frustrated the prosecution, because their objective was to get a conviction before the election.
Here is where the prosecution, in their zeal to accelerate the pace of the proceedings, berated Judge Cannon for the delays. By this time, this same prosecution team (also engaged in the Trump / J6 case) had been required by the DC courts (the venue for the Trump / J6 suit) to have not adequately taken the question of presidential immunity into consideration. NOTE: This was long before SCOTUS passed down their ruling with respect to presidential immunity. The DC Appeals Court took up the matter of presidential immunity with respect to the Trump / J6 case. Simultaneously with the DC Appeals Court internal deliberations to consider whether or not to take up the presidential immunity matter, Jack Smith’s team sought to leap-frog the DC Appeals Court and get SCOTUS to rule. This was a big mistake, because such a request is not consistent with the prosecutorial acumen of a legitimately appointed Special Prosecutor (like Mueller).
Judge Cannon, recognizing Jack Smith’s dubious prosecutorial acumen in the Trump / J6 case, became more amenable to Trump’s requests for the discovery material in the Documents … materials that Jack Smith’s team had fought to not disclose.
Here is where the Jack Smith prosecution of the Documents case started derailing.
Jack Smith’s team provided a trove of new documents, but they were redacted to the extent of rendering them as useless. Motions and counter motions were filed. Eventually, Judge Cannon ruled that most of the redactions be removed.
It got worse for Jack Smith. The now-Unredacted files revealed the evidence tampering by the FBI and the DoJ’s coverup of that evidence tampering. Furthermore, the prosecution was exposed for a combination of coercion & quasi-bribery to get one of the defense lawyers to ‘flip’ and become a witness for the prosecution. While Judge Cannon did not dismiss the Documents case on the basis of either of these major instances of prosecutorial misconduct, the prosecution’s poor ethics opened the door for an amicus brief filed by former Reagan era AG Ed Meese, in which the Constitution’s provisions for the appointment of a Special Prosecutor (Special Prosecutors can only be chosen from among US Attorneys) were contrasted against the un-Constitutional process by which Jack Smith (who was never qualified as a U.S. Attorney).
From what I understand, Judge Cannon, examining the unethical conduct of Jack Smith in the light that he was not a US Attorney before being chosen as Special Prosecutor, led Judge Cannon to dismiss the case as not being legitimately brought by the government.
case by then suspicious about Jack Smith’s

I assume this was be appealed. Wouldn't be the first time this Trump-appointed judge has had one of her pro-Trump rulings overturned, and she also has a history of ethical violations. I don't know much about the case, though.

As far as the political objective of this case, e.g., to get a felony conviction of Trump before the election, a do-over of the case won’t help.
For a do-over to take place, the evidence against Trump must be researched and then compiled all over again; a new grand jury must be empaneled (this time, in the correct venue of S.Florida instead of D.C.); the grand jury must be allowed time to render a ‘go’ or ‘no go’ for a new ‘Documents’ case to be filed against Trump.
Then, a new indictment must be filed. Discovery materials, starting from scratch again, must be prepared and made available to Trump’s team.
(*). I’m not a lawyer; I’ve just followed these Lawfare suits against Trump closely and tried to learn something along the way. Who knows, I’m an amateur making legal predictions. To that end, I assume that a new Documents case can be filed if the DoJ wants to do it. As for timing for when a new indictment might be issued, I’d be surprised if that happened before year end 2025.

I dunno how that works.
Given the egregiousness of Jack Smith’s conduct as a prosecutor, it would seem reasonable to disbar him.
After all, behavior like Jack Smith’s, if it goes without severe punishment, casts suspicion on the legitimacy of our legal system.

We’ll never know if Judge Cannon would have managed to postpone this case for illegitimate reasons in order to help Trump.
The DoJ knowingly gambled on the appointment of a (un-constitutional) Special Prosecutor based on somewhat recent history of other such un-constitutionally appointed Special Prosecutors carrying out prosecutions for the government. (For exam0le, back in the Bush presidency Bill Barr had appointed Special Prosecutors who were not US Attorneys.)
The problem with Merrick Garland justifying his choice of Jack Smith as Special Prosecutor, despite the absence of Mr. Smith’s status as a U.S. Attorney, was based on (in part) Bill Barr having gotten away with this decades ago. The problem for M.Garland (and this would otherwise would have been the problem for Barr), is that the defense in those Barr cases never challenged the constitutionality of those non-US Attorney status Special Prosecutors.
Trump’s team may well have missed this ‘Special Prosecutors can only be US Attorneys’ law if former AG Ed Meese had not written his amicus brief to both the DC Court and the S.Florida Court. The Trump defense used the ‘illegal appointment of Jack Smith’ argument, and the S.Florida Court agreed.
The lesson here is that an unchallenged federal prosecution in which the prosecution got away with doing something illegal does not magically transform that misdeed into something legal. However, it looks like our court system requires the defense to raise questions about the legality of the prosecution’s actions before they (the courts) weigh in.

That's all false. Almost every bit of it.
When the appeals court reverses her, it goes to a new judge, case intact. However, the whiners will appeal to SCOTUS, and given the corruption at that level, they might actually side with the idiot judge in Florida. All bets are off now.

Appeals are not do-overs.
The eleventh circuit in Atlanta will be the appeals destination. This is a ‘politically balanced’ appeals court. The best outcome for Team TDS will be for the 11th circuit to refuse to take up the appeal. That will save time, and allow the DoJ, if the next administration’s AG chooses to pursue it, to start all over (a do-over) with a new case.
(If 11th circuit decides to look at Judge Cannon’s ruling, then I’m betting that they’ll say no to overturning Cannon’s ruling. Next, SCOTUS will not take up the next appeal. The Jack Smith led case will then be cremated.)
If the next admin’s AGE wants to try a do-ove, then that next time will be prosecuted by a legitimately appointed Special Counsel from a roster of US Attorneys.
A whole new grand jury must be empaneled. Etc etc etc.
Keep chanting and burning your candles. That's your best bet.

The only judges loopy enough to support that are probably Thomas and Alito. Probably. SCOTUS has raised its bar for loopiness lately.
The idea that a newb judge from freaking Fort Pierce, Florida - by far the smallest in terms of caseload, resources, and importance of any court in the Southern District of Florida, who has absolutely zero meaningful experience and who was already slapped down (hard) by the 11th Circuit, thinks she can tell the Executive Branch they can no longer appoint Special Counsels is, well, past the point of stupid. If there was the slightest bit of justice she'd be impeached tomorrow and banned from the bench for all time. In Florida, though, well....
The only thing she likely did accomplish, though, was to buy Trump some time, because it'll take time to appeal, which may well have been her intent. It means the case is virtually 100% certain to not be tried before the election, and of course, if Trump wins, he'll just dismiss it and that's that.
I'd expect the more extremist Trump-appointed judges to get a whole lot rowdier the next few months. They think their God King is returning and they can get away with anything. Of course, if he wins, they're right.

This is Clearance Thmoas covering his ####, in saying "special councils are unconstitutional", cause guess what, one was just appointed to investigate him, and Judge Karen in Florida ran with that. Florida's 11th circuit also has a crack at this, meaning Cannon is no longer relevant in this case.

She actually did give up control of it with an obviously wrong ruling, so she is assuming Trump will win and pardon himself. The appeals court is going to embarrass her more than it has in the past, but she obviously has no shame. Some of her other reversals have been brutal, stopping just short of calling her an idiot.

Just saying, it took her 3 months to wiggle out of it, and she quoted Clarence Thomas brazenly stating that special councils are unconstitutional and referred to his opinion in her 90-page dismissal. This is all about Thomas, who BTW has been missing recently.
