Florida Supreme Court just ruled that the suit can continue in Florida courts. ACC appeal to the court to stop the suit claiming the suit should be filed in NC and FSU had no standing to file it in Florida was denied. Discovery has started. Hopefully depositions will begin in 2-4 weeks.

That has to have ACC (and some former FSU) administrators concerned.

Wouldnt the ACC just appeal to the federal courts since we are effectively taking about domain and interstate commerce here?

I don't know what recourse ACC has now.

But, until they get a federal court to stop the suit discovery will continue.

I think the FSU AD was dumb to come out and boast that they had a great exit plan strategy. He now looks like an idiot and is finding out the GOR is more solid than he expected. The ACC can drag this out for years eating up the money that FSU could have used on more productive investments. I read where this suit is costing FSU $1mil per month while Clemson has spent $2.2m on their suit. The article suggested that The ACC was into everything for around $3-4m. I cant find the article, it was couple months ago, but $15-20m spent and nobody is closer to a resolution. Although the ACC is going to offer distribution bonuses now which will help.

....there is no way FSU is spending a million dollars a month. I have seen reports that they have spent 1-3 million so far. That sounds like a lot. But, if they spend 5 million dollars and get out of ACC even one year sooner and get into P2 they will gain about 30-50 million bucks. That's a pretty good return on investment.

Same with Clemson.

The lawsuits are all about hastening the exit.

They wont get out for under $130m at the minimum according to article and it would be clost to $500m if they just bought their way out today. I wish I could find the article, but I feel confident FSU has spent more than $1-3m based of everything the article layed out. It was interesting but I dont recall all the line items they stated.

You have insight that the FSU admin and lawyers aren't aware of?

I trust they know what they are doing just fine, thank you. I also believe ESPN doesn't want to be dragged into a Florida courtroom. At the end of the day, FSU wouldn't pursue this if they didn't think they could save time/money (and probably both).

That's a fact....what about estoppel, statutes of limitations, patent and CCC contract law...FSU law school must specialize in horsemeat...wait until the other members of the ACC sue FSWTC for breach of fiduciary responsibility to the other members of the conference while costing the conference millions of $ with a bogus lawsuit while accepting funds from the conference! Counter suit for lack of good faith in approving the GOR! You actually may be a FSU attorney!

Yes if settlement negotiations are stalled. I suspect they could get a federal judge to put a stay on discovery.

And the US Supreme Court would have to agree to hear the case

The Supreme Court only hears 1% of the cases that are appealed to it

This is just going to drag on it seems. I applaud both schools for trying to better their situations but I believe the GOR expires before all these legalities play out. I mean are we just now to the point where we know what state the suit will be held. Unreal

Instead of 2036. This will allow them to be picked up in the next round of B10 and or SEC TV negotiations which is when the next realignment will occur. Hopefully there is some truth to the rumors that the recent ESPN re-upping allows for some type of reduced early exit price.
