Could the SEC & Big 10 be sued for antitrust?

With the courts ruling that college football is a business, they could be exposed to charges of collusion to limit competition

The courts haven't ruled that college football is a business.

They probably could, but when is the last time you saw a antitrust suit brought and actually succeed? Who is going to bring that case? More importantly, don't you think that is something both the SEC and BIG are making sure they are protected from any potential lawsuits?

House vs the NCAA

Exactly. Also Ohio vs NCAA.

However, using the NCAA is different than one conference using others.
The SEC and BIG are competitors to the ACC, not a governing body. The issue in the House and Ohio cases was the NCAA illegally restricting free trade and restricting freedom of movement.
The SEC/BIG aren't doing that to the ACC.

Does regulators breaking up a company or blocking a merger count? United Aircraft, Bell Telephone, and a proposed merger of GE and Honeywell (in the 90's). I am sure there are more but these are big ones so it does happen.

Perhaps a long, drawn out legal battle could give Clemson a chance to better position themselves for protection from the fallout.

A reason why they both came with a team of lawyers to their most recent meeting.
If you remember there was a potential issue years ago and driving force behind G5 being given a seat at the table for playoffs.

coupled with the amount of money involved, ABSOLUTELY!
Wouldn't surprise me at all to see E$ecPN named as a co-defendant as well.

You can sue anyone for anything at any time

Winning is another matter.
It's unlikely that a suit against the P2 would succeed.
There are too many other teams that actually draw more tidal fans, and that have a larger geographical footprint.
The P2 doesn't have a monopoly or anything close to it. Without that, it's very difficult to prove antitrust claims.
It's kind of like a business like Ace Hardware suing Lowe's and Home Depot because they are bigger franchises and make higher profits. Nothing in the Lowe's/Home Depot model prevents Ace from competing or from being successful.

Absolutely correct. There are hundreds of college FB teams. The BIG and SEC does not have a monopoly on FB teams. They just happen to have a better product. The lawyers attended that meeting because private equity was being offered. I'm sure the colleges wanted to know the legal ramifications of that.

Ace Hardware corporate just decided to declare bankruptcy and hope to continue supplying the franchise stores..... sounds somewhat like the ACC...

Those folks don't have a monopoly on football...however if they create an atmosphere where they can control the relevance and much of the money and bowl games, who gets on TV, and who gets a chance to win a natty. Then you have a case! When Standard Oil got hammered there were small oil companies everywhere, anybody could refine oil, Standard with its reach, transportation, capital etc. Sought to use its power to control all means of mining, refining and marketing to exclude others! Sounds kinda like college football now! Broke up Standard into smaller pieces...made the parts more powerful! KEEP the government out of the business!

It is getting to be a monopoly without being a monopoly if you follow. They have bought up all the better teams and will slowly fade out competition from outside their P2. Not sure what the legal term for that is but a lot of teams are and will be squeezed out of relevance.

Apparently it used to draw a lot of laughs at Gamecock Club meetings when their administrators would exclaim that they will always vote against Clemson joining the SEC in order to gain an advantage.
I assume their lawyers told them that is now a legal matter.

I think they are including teams they believe are competition.

They speculated on a model which showed 60 or 80 teams being cast as the foundation of the new organization. Though it won't be based on which teams are the best but rather on which teams have the biggest viewerships, it still includes every BCS team and allows for others to participate in the post season games.
I don't like it because I believe Clemson won't make the upper level even though we've been a regular in the playoffs.

Do you really think that someone would form a 70 team league - and want to leave Clemson out of it ??
I am very wary of the private equity situation because there is a lot about it that I don't understand, yet. However, it may be a better alternative than allowing two conferences kill the rest of college football competition. I would like to hear more about it.

How could we not be in any advanced group in college football...Who else over the CFP era would you include? We produce a premium product every year and fill a beautiful stadium game after game! Miami can barely fill a toilet bowl, UNC is anemic and powerhouses this year are out the next, look at poor FSU, the best losing team money can buy, or UF or Auburn...Texas is great this year, look at the last 10, try Wisconsin, or USC & UCLAy...Texas A&M has never been able to produce a good BM with all the money in the world! Leave Clemson out and you make the modern era of college football irrelevant!
