Nor should he. Gun wasn’t his and he didn’t even know it was on the car, even if he did, it was completely legally stored on the trunk. Those that want him to portal or gone need to portal themselves as fans, DK did far worse, multiple times and was finally kicked off after the forth. Demonte is a great kid, back off.

Clemson does have a strict no gun policy on campus, and regardless of how I may feel about the rule, I do respect the importance of actually enforcing the policies that are enacted so that they can be effective and fair for everyone. But with that being said, if the situation occurred as you described it that shouldn't be made into a big deal in my opinion. He shouldn't have had the gun in his car, and he should have known it was there. But he didn't have it there knowingly, it was not discharged or brandished at or shown to anyone, it was not brought into any buildings or carried anywhere on his person outside, and it was kept safely stored inside the vehicle. Considering all of these factors, I think this should be viewed as a very minor infraction. Capehart didn't act reckless and wasn't trying to endanger anyone. I don't think he should be ousted or harshly punished for this at all. Hopefully he'll just learn to be a little more careful from now on, but that's the type of thing that could happen pretty easily by accident, and in this situation, fortunately, was harmless.

CUGRAD1980® TigerPride97 Normally I'm extremely pro-gun, but when I see responses like these it makes me realize why so many people don't like you guys. Yes, you have a constitutional right to own a gun, and that right should not be taken. That does not mean, however, that you are allowed to carry guns anywhere you want inside the United States, as you should know full well. Private facilities can set their own rules. Libraries, government buildings, schools, and many stores frequently don't allow firearms inside their property. You can usually see signs on the doors or outer walls of such buildings that will tell you this. If you don't believe me, try bringing a gun with you into Death Valley for example. You'll find out real quick that won't be tolerated.

Clemson University has a legal no gun policy on its campus that applies to everyone, and they are allowed to set it because they have the authority across all campus property, which is owned by the University. And for the record, I never even said I personally liked or agreed with the policy, just that Clemson has the right to set it. And if it is the policy, it needs to be enforced by the University and adhered to by everyone. You shouldn't have such a cavalier attitude that you think you can turn up your nose at a particular Clemson rule just because you don't happen to like it, particularly as a Clemson fan. That's a very dangerous mentality. And as I also said, I don't think that what happened with Capehart is a big deal and I don't think that he should be punished for it or kicked off the team or anything like that. He clearly didn't do anything dangerous and had no bad intentions. My previous post was actually in support of him. I just said I hoped he'd be more careful in the future about knowing what's in his vehicle.

South Carolina Code of Laws section 16-23-420(a) addresses carrying a weapon on campus and reads: "It is unlawful for a person to possess a firearm of any kind on any premises or property owned, operated, or controlled by a private or public school, without the express permission of the authorities in charge of the premises or property." The provisions of this subsection related to any premises or property owned, operated, or controlled by a private or public school, college, university, technical college, or other post-secondary institution, do not apply to a person who is authorized to carry a concealed weapon pursuant to "The Law Abiding Citizens Self-Defense Act of 1996" when the weapon remains inside an attended or locked motor vehicle and is secured in a closed glove compartment, closed console, closed trunk, or in a closed container secured by an integral fastener and transported in the luggage compartment of the vehicle.

So you actually CAN have a gun on campus, but only if A) you have a concealed carry permit and B) your gun stays in your car secured within some type of container. I guess there was some dispute over whether Capehart met these conditions when he was arrested, but from what people have said, he had the gun in the trunk, so it sounds like he was in compliance as long as he had a permit. Again, I don't think he did anything bad. But as you can see, there are gun regulations at Clemson that extend beyond what they would be ordinarily because Clemson is a school.

Do you know what it would take to take your guns away? It would require a change to the constitution. Guys like you spend a lot of time talking about the 2nd amendment but don’t really understand it. It would require a 2/3rd vote in congress and then would have to be ratified by 3/4th of the states in order to change a constitutional amendment. It’s only happened once in 200 years. Our congress couldn’t get 2/3rds consensus on a bill stating that children love puppies much less something important; and it would only take 13 states to oppose it, we could muster that without even going west of the Mississippi. So next time the gun industry tries to scare you with some story about a low level progressive lib who’s trying to ban guns in some random county in New Hampshire; know it ain’t gonna ever happen until the constitution changes.

So let's just say, if we had a track record of literal data points to show how the creeping incrementalism of government regulations on firearms never stops, you like, would still sit there and say slippery slope arguments hold no water?

I truly think some people had no idea where they were going or thought it would stop because "reasonable" or "common sense" when they were being loaded onto cattle cars.

I have more data and logic to support my stance that when you attempt to ban your way to total safety, there is no logical stopping point than you do to say we will. Ironically, you act as if our position, based on historical track records is somehow extreme or wild, yet it's you who is ignoring clear trends and data driven projections.

To be clear, you believe the potential tyrannical government that the 2nd Amendment is specifically outlined to help citizens resist, should have the authority to determine what weapons and where those weapons can be owned and operated to potentially resist them?



The fundamental problem with this way of thinking is that it's protection of your own subjective definition of "reasonable" which doesn't apply. The 2nd amendment doesn't exist as a right the government gave us and can regulate. It's God given and a right to self preservation simply outlined in the constitution to prevent the government from assuming authorities they don't have.

I need my gun as well to defend myself in the event I encounter someone looking to harm me or my family. You can choose to go without and down play the nee, but the news I’m hearing everyday says something different.

The parade as usual were trouble makers,so it sounds, and who knows how they got guns. Rumor has they bring them in through Mexico like the drugs for decent prices. Again people complaining about gun laws and they do not even enforce the ones we have. Makes no sense.

Don’t think I’ve ever attended a Clemson sporting event when there weren’t several guns in the car and I’d assume thats more of the norm than the exception. Ridiculous in the state of S.C. this is even allowed to be a law considering the University is a public state institution

You are correct. If you have a CWP, it is not illegal for a gun to in your car on campus, as long as it is secured properly.

Why not go to the west side of the University of Chicago and walk across Washington Park at 11 pm...you will see why everyone needs to own a gun and be trained in its use! Same stuff goes on in Hotlanta, Detroit, etc... the old west was benign compared to JBs america!

All this over this... We have made laws that go beyond common sense when we should put offenders away for good, period.

He was raised in Hartsville... I live several towns away and my boys hunted ducks and deer before school and almost always had some form of firearm in a truck....

Unfortunately, good people get caught up in well intentioned laws designed to protect and thugs walk away to be thugs again.... Go figure.

A key detail about this is that the arrest happened at 8:15pm which means it was dang near daylight when he got pulled over for the "traffic" violation. It's not like this was a 2AM or 3AM ordeal here.

This is his fifth traffic citation in Pickens county, third on campus. You get stopped for speeding and running stop signs on campus a couple times, and they all start to recognize you.

As is the case with players committing these level of offenses Capehart will be sent to Dabo's doghouse and tasked with accomplishing certain goals as prescribed by Dabo to earn his way out.

Once he meets said goals he will return to good standing and Capehart will have learned a valuable lesson.

Just wondering if every vehicle was searched during game day how many would have guns? Not saying this would make it right but with a detail investigation hopefully he will remain on team after some type of discipline. Going forward everyone obey traffic laws while on University property.

How did someone put a gun in his trunk without him knowing it? Sounds a little odd, it could be fentanyl next...Do think Dabo will dump someone without some due process...get a life...coaches have dealt with this stuff before...are we drug testing our players regularly?
