This goes to show things can happen anywhere. Building a house last several months. Neat the end of the process and last Friday I was over doing some things outside when a young guy drives up asking strange questions. He drives on up the driveway, gets out his car and just starts hanging around. I approach him again and he asks more strange questions. I ask him to leave, he does not. Finally call the police and have him trespassed from the property.
Trying to keep this short, he returned Saturday and I called the police again. He left before they arrived so nothing they could do. Early Sunday morning I get alert from trail cam I have keeping an eye on the place. Turns out he cut the strap from the cam and through it in the woods. I found it and moved it somewhere else.
Monday morning, I drive by early just to check on the place. He is up by the house with no car this time. He walks to my truck again saying basically nonsense. He walks back to the house when he realizes I am on the phone with the police. They arrive and arrest him. He had broken in a window and was in the garage when the police arrived. He was charged with burglary, possession of ammo by a felon, meth possession and resisting arrest. On facebook he has a photo of my house stating it is his. He told the police my address for his residence and claims it is his house.
Long story to say: beware. If this can happen in Spartanburg it can happen anywhere.

Yep, my wife and I have twin M&P Shield 40 cal and they both fight dirty with plus P ammo We pray that we never have to use either other than for target practice. But as the saying goes it's best to have it and never need it, than to need it and don't have it. I pray that we never have a situation that we need them!!!

I've seen a number of these stories now where the squatter has more rights than the owner. So what of you decide to be the squatter? Do you then have more rights to your own home over the original squatter?
It's a sad state of affairs when people have to "out-squat" squatters.

A squatter in FL can claim no right for any reason from the original property owner. Renters have some more rights, but basically you're gone within 48 hours if the owner says so in FL
|

You pretty much would have to let someone live on your property for 10 years without trying to remove them for trespassing, for them to take over you property in SC

I think that same rule goes for a neighbor building a shed or fence or even an addition to their house over the property line. You have to address it ASAP, otherwise they can end up effectively moving the property line.
I was in that situation with a shed, installed years before I bought, maybe with permission of the previous owners - no idea. However, new owners dismantled it and I promptly supplied them with a survey, showed them the physical pin locations with a mag locator, and told them not to rebuild anything over the line. I did have to explain how magnetic north changes when they questioned the survey vs a tax map - remarkable how many people don't understand that.

I knew Florida did, I'm glad SC did as well. The insanity of giving squatters living/trespassing rights to someone else's property is just dumb. The politicians that fought for the squatters obviously haven't had someone try squatting on their $million home.

Ours is not as tight has FL, but like I said earlier if you allow it to happen in SC then it is on you as the property owner not to check on your property and remove them for trespassing, which is what it is, unless you have allowed it to continue for 10 years.

Did you know that the murder rate in NYC is around half of the murder rate in SC? Rates of other crimes are similarly lower.
NYC - 5.3 homicides per 100k population SC - 11.8 homicides per 100k population. A lot higher than the national average (7.0)
You are far, far more likely to get a timely officer response to a 911 call in NYC than in either Florida or South Caroline. That is why the crime rates are so much lower in NYC.

Have also heard about increases in property deed fraud. A person with a fake ID is able to have a quit claim deed processed by the county registrar to take ownership of the targeted property. I need to have my deceased wife's name removed from my deed and need to see if I can include restrictions on the new one as to what owner identification documents would have to be shown for a transfer to take place. One I'm thinking about is my DD Form 214, but will discuss the situation with a RE attorney to see what options are possible.

That doesn’t qualify as squatting. SC states he place must be abandoned 5-20 years and in adverse possession by the squatter for 5-20 years. It has to be conspicuous and never challenged by the landowner. You have a case of crazy with trespassing. I’m sure you haven’t signed the C/O (cert. of occupancy) because it sounds like you haven’t done final inspection. I’d have a restraining order filed and possibly consider putting an RV and camping there to keep it safe

Dealt with this a couple of years ago. I had been renting a home when the worst of these individuals decided to take advantage of the situation during Covid which exacerbated the situation and were given the right to continue their residency in lieu of having been layed off or lost their job due to Covid
After they removed those protections she continued to live there believing she couldn't be evicted. Even dared me to take her to court.
I decided to just sell.the home and went to court.
The judge basically laughed her out of the courtroom so she decided that's a great time to curse out the judge. Bad idea. Real bad.
These things should not be allowed to happen but such is life.
But the Good Lord blessed me with timing perfection. At the times homes were in huge demand and potential buyers were submitting ridiculous bids. Sold the house the first day it was listed

I’m overseas so it took while to get back to me some one was in my house. Neighbors and even some family saw the guys and talked with them but they seemed legit just checking on this or looking into that for me. Word got to my brother who immediately talked to me and process started to get rid of them.
They disappeared everything inside. No records, no way to connect to anyone. All cops could do is trespass them, take them in and would be released after processed.
Thing that still ticks me off to this day is everything I accumulated from 20 years overseas is just gone, nothing of real value but memories. My mounts from africa hunt gone. I’m feel my blood pressure rising now.
It is a huge issue if you have to deal with it.

Get an electric bill for that property ASAP. Read an article that said they scope out the place and get a utility account for the address so they can try prove it’s their home.
All of this business kind of makes you want everyone to have housing, regardless of wealth. No one needs to be outside when there’s millions of empty homes, and builders cannot stop building

Spread around the country, but mostly in areas that have been losing population. Something like 16 million vacant homes, but a big share are second/vacation homes. More are in between residents, waiting to sell or rent. There are still millions vacant and not for sale or rent, for one reason or another. Almost all of the examples I can think of aren't in shape for people to live in without major work.

I hope and pray that is the end of the problems with this guy. Even though he was not threatening towards you that could change and obviously this guy is out of his mind on drugs.
His jail stay will be short, they let these types go back into public for whatever reason and continue having issue after issue.
Bring back mental health facilities, fill em up. Meth heads and other druggies on the streets are no good at all. Feel bad for them but being in an institution and not on the streets would be an improvement. Country is swindling away a little more by the day. Charlotte is getting bad, right across street from where I work is an old dog care place that was vacated years back....has turned into a homeless hangout and every single week police and firetrucks are back over there probably saving someone from an overdose of some kind. It is a tough situation since they have no place to go and are all strung out on drugs. The place needs to be bulldozed, looks terrible and property is not being kept up by whoever owns that lot so grass is not being mowed but every month maybe.
