Lawsuits are tools, like crowbars or socket wrenches. They leverage something or turn something this way or that -- if they end up in court, they've actually failed to do what they're designed to do.

FSU sued to make a statement, make some discovery (which the media will have a field day with so long as there are *CREDENTIALED* media who are sourced well enough to discern the key points), and call the question.

The question being whether a conference, by virtue of GOR, is greater than the sum of its parts.

Well we all know it is not, because it is just a collective; a collective formed to maximize revenues through the power of collective bargaining with TV networks.

And as the power of the collective has eroded in the face of other, more powerful collectives bargaining for a larger share of a limited revenue pie, the members have panicked.

So, now that they have the CFP snub working in their favor from a public opinion standpoint, all FSU is doing is busting up a collective. But instead of using pipe hitters and thumb breakers, they're using lawyers.

So it's not a W-L deal. It's a "Did we effectively position ourselves to, with as little financial pain as possible, get free of the collective as soon as possible. And the rest of y'all can figure it out for yourselves."

I'm not a lawyer. But I did stay at a Holiday Inn Express last night and am closely related to several lawyers who, like me, like to drink bourbon and then go post stuff on TNET.

If I am correctly understanding FSU's lawsuit, they're positioning themselves based on the ACC's alleged material failure to deliver on contractual obligations.

But, that's just my opinion on the situation.

Here are some highlights from the lawsuit document:

Pg 32. COUNT III THE ACC MATERIALLY BREACHED ITS CONTRACTS WITH FLORIDA STATE

Pg 34 COUNT IV THE ACC BREACHED ITS FIDUCIARY DUTIES TO FLORIDA STATE

Pg 35 COUNT V FUNDAMENTAL FAILURE OR FRUSTRATION OF CONTRACTUAL PURPOSE

And they can't.

Because "The stunning exclusion ..." is the entire basis of their complaint. And it won't hold water.

And the typos peppered throughout make it hard to take seriously, too.

And that FSU's own president agreed to the GOR extension without doing any due diligence beforehand is embarrassing.

But none of it matters anyway because, again, they're jockeying for position.

The ACC was very careful when they presented the grant of rights contract to every member institution. This was not something they slapped together in a few hours. They spent many months of legal time and expertise to make sure that the contract was on solid legal footing and that the contract couldn’t be broken because a school changed their minds.
