when ESPN negotiated its deal with the league and Swofford insisted that any deal with the ACC had to include Swofford's Tar Heel buddies at Raycom (including Swofford's own son), has now come back to bite him in the a$$.

because of its business model. They own not only the rights to the game but advertising time as well.
I also wonder if them be located in Charlotte has anything to do with the issues. Raycom would probably be out of business if the didn't have the rights to ACC FB and BB...

The Raycom syndication model for televised college sports events was different from traditional syndication techniques and it helped distinguish the company from its competitors.
From the start, Raycom had a unique business model. Instead of sharing equally advertising inventory with television stations, the company paid monetary compensation to each station in exchange for controlling almost all of the advertising minutes in each telecast. In that manner, advertisers could not have their messages in a Raycom game unless they purchased the time from Raycom. While risky, the strategy paid off as Raycom was able to generate more revenue by controlling almost all of the advertising.
Another unusual business technique was pioneered when Raycom established a central monitoring system within the company headquarters. Employees documented each commercial and the time it was aired. They also communicated with each station’s control room during the game to ensure that the game was being telecast completely with all commercials airing. The following day, advertisers would know the exact number of commercials and the markets in which they had aired during a respective game. This facilitated billing, and gave advertisers assurances that they were not accustomed to receiving.
Raycom pioneered a customized “traffic” system that placed commercials into program and production logs that guaranteed advertisers separation from competitive commercials and assured that the commercial was aired in a different game location in each telecast. The system handled hundreds of games each season and as many as 14 games on a single weekend. Under the supervision of long-term employees Scott Crowder, Marilyn Haley and Deanna Rothgeb, this system became a model for other sports syndication companies.

A little Germans but still don't put much credibility into it. A little deal with Raycom will not stop the ACC Network. Worst case scenario ESPN buys up a little network like Raycom and uses its network, broadcasting, and infrastructure to host the ACC network. Couldn't really cost more than starting up another network from scratch. ESPN already did this dance with the SEC/CSS if they are talking with the ACC about the network they have already addressed a resolution for this issue.

If ESPN was desperate, which they are not, they would simply strike a deal similar to the CBS/SEC deal and give Fox a game per week to broadcast.

Why would ESPN get desperate to deal with the likes of Raycom or in this case Fox Sports who is a sub contractor's sub contractor in this case. ESPN sees this as a pebble in the road, but people always want to make it out to be a big deal.

Your talking about a contract that ESPN wrote with look-ins to discuss possibilities such as a network. Do you really think a huge company like Disney/ESPN doesn't do this in a favorable manner for themselves. The rights that they sold don't even cost "an arm and a leg" and ESPN would get out with a slap on the wrist if they refused to uphold the contract. Sure it will cost some money up front but its not that big of a deal long term. ESPN sold SEC rights to CSS (comcast) and were able to negotiate it just fine.

agreement...The ACC sold all our 3rd tier rights to Raycom, who in turn sold BB and FB games to FoxSports... To start a network, we need those rights back...Getting back Raycom's is one thing, but what motivation does Fox have to sell us back their content so a rival network can air it?

No ESPN owns all of the ACC's TV rights. ESPN sold games to Raycom who sold games to Fox Sports. That means ESPN holds the primary contract and will have to negotiate, not the ACC. This is the same deal that ESPN had with Comcast for SEC TV rights. Read the article below. We are talking big business. Fox Sports is not going to make a substantial amount of money broadcasting the leftovers after ESPN and Raycom take their pick. In all honestly they might be excited about the prospect of getting a paycheck and not having to put work into producing or broadcasting any of the games.
