where the senate is out of town but won't go into recess to prevent recess appointments is used to block the confirmation process.

I don't know why Trump is saying they must commit to recess appointments instead of saying 'go into recess when you aren't in session' but I think that is the gist of it.

Recess appointments were once controversial, last-ditch efforts for presidents to install their nominees after facing long confirmation odds in the Senate. President George W. Bush appointed John Bolton as US ambassador to the United Nations via a recess appointment, for example, as it was unlikely he would have made it through the Senate.

Senate Majority Leader Harry Reid, the Democrat leading the Senate under Bush, then decided to make it so that the chamber simply never recessed long enough for such an appointment to be made. When senators left town, the Senate held a “pro forma” session to prevent any recess appointments.

This was continued under then-Senate Majority Leader Mitch McConnell and then-President Barack Obama — a clash that made it to the Supreme Court. And after the court ruled in favor of the Senate’s powers, the pro forma sessions continue today.

was unable to get a bunch of his appointments through the Senate and started using the Recess Appointments Clause (Article II, Section 2, Clause 3) of the Constitution. The Democrats didn't like it so they "one upped" Bush by just not formally recessing the Senate.

In a game of turn about is fair play - Republicans played the same Senate is not in recess game on President Obama in order to prevent him from making some recess appointments that Republicans did not like. Eventually Obama got tired of playing this game and made some appointments during one of these Senate 'non-recess/pro-forma' periods. It wall went to court with the Supreme Court - in a 9-0 ruling - declaring the appointments were indeed unconstitutional.

During Trump's first administration - the Senate played their typical DC reindeer games and greatly delayed a shidton of Trump's appointments. The backlog of his appointments got to the point of ridiculous - some taking 3 years to be voted on. In order to avoid this whole thing a second time - Trump wants the option to use his Constitutional Recess Appointments authorities. However, in order to use those Constitutional authorities - the SCOTUS has already ruled the Senate must, in fact, be in recess. That is why Trump is demanding any Republican Senate Majority leader clarify their stance on this very issue of 'recess' right now.

This is all part of the game - Presidents from both sides have used recess appointments to get people that might not otherwise be appointed, expedited, or immediately in position. IMO - both sides of the argument are playing reindeer games: the President using recess appointments to bypass the Senate approval process for controversial appointments; the Senate opposition intentionally slowing down the appointments process to a trickle in order to hamstring a Presidential administration; AND the Senate refusing to go into recess in order to deny a President the ability to make recess appointments.

Neither side is righteous in their motives but as long as we follow the Constitution so be it.

...is that neither side, by employing these tactics, is trying to acknowledge the spirit of the law. They're just all interested in finding the random loophole that allows them to force their decisions through without any kind of oversight -- OR to provide a ridiculous level of oversight that encourages more people to search for similar workarounds.

People aren't interested in doing what's best for the country. They're just interested in making sure their side wins. And they conflate the two efforts.

of the issue. It's all about increasing or decreasing someone or a Party's power.

Term limits while reducing the size and scope of the Federal Government... Take away the ability of people to make a lifelong career of politics to where their own time in Government is limited and some of this ridiculous political gamesmanship may wane in favor of actually getting things done.

Reagan, GW Bush and Clinton all used the recess appointments power wholesale. Again - they used a tool afforded to them in the Constitution so ultimately I just give it a shoulder shrug as there is precedent for it's use...

If it wasn't a part of the process it wouldn't be an option. The Cabinet and positons requiring Senate approval still have to be confirmed within 2 years after a recess appointment. My take is that Trump does not want to get involved with the Senate Leader selection (and shouldn't) so he is saying, don't select a RINO as the Senate Leader!
