endorsement for the ACC, but I have one big question. He sounds like e are waiting for contact from them. Don't we have to contact them first in order for them to avoid lawsuits? What's the deal?

It's just PR speaking.
The underlying tone is that there is interest.
OK so, A&M said they were interested in the SEC, after rumors started swirling that the SEC invited A&M.
So Baylor started making noise about suiing.
The SEC "withdrew" its "non invite" publicly. A&M then wen tthrough the motions of leaving the conference. Once they did that, they were formally accepted by the SEC.
There is a process to this that has to be made and done in order for lawsuits to be avoided so words have to be chosen carefully.

I'm sure that if we are in talks there will be all kinds of games being played to maintain plausible deniability to try and avoid as many lawsuits as possible. I'm sure the rest of the ACC is going to be pretty displeased if FSU and Clemson leave the ACC and might get litigious.

until it is officially ironed out. Of course we havent contacted them "officially" or "directly" but there has been contact I believe through intermediary routes.

after the Big XII and BCS meetings we'll announce we're looking, make official contact, and an invitation will be extended. When we leave we can say we gave the ACC every opportunity to keep us, and they could not meet our needs. Still a month, month and a half from this being finalized is my guess. Do believe it gets done

no official contact. All FSU and Clemson have to do is to say they are exploring other conferences. Then the Big 12 will offer. And like that we will be in the Big 12. The Big 12 invitation is almost a guarantee at this point.

Do you have any clue as to the legal ramifications of TDP saying "yes we've talked to the Big 12 about joining"?
