"When a fetus growing inside a woman reaches viability, when society can assume care and responsibility for that separate life, then – and only then – may society intervene. An arbitrary six-week ban on (post-embryonic cardiac activity pregnancy) terminations is inconsistent with these rights and the proper balance that a viability rule establishes between a woman’s rights of liberty and privacy and society’s interest in protecting and caring for unborn infants,” McBurney wrote.
So the judge isn't saying there can't be an abortion ban after a certain time, but that six weeks is too early and arbitrary. And let's be honest, six weeks is a little silly.

It's not unusual for women to already be 6 weeks pregnant before they even realize it, and most birth defects can't be detected that early in the pregnancy.

I read what he said, but I still haven't seen where the Ga state constitution speaks about abortion.
You really say this about any number of weeks/months. He ultimately overturned a law that went through a democratic process.

You said it was done by a democratic process, but that doesn't always make it constitutional.
A 6-week ban wasn't practical. It made it illegal, under penalty of prosecution, to get an abortion past the time when most women don't know they're pregnant and when the fetus is viable. These 6 week bills are gaming the system and not giving women any chance of early control over their bodies. Sorry, but the liberty applies there.
