Feel however you want about FSU/ACC and the GOR....

but it's darn odd that this document is in one location and you have to fly TO the ACC HQ to read it while being watched.
No notes. No pictures of it.

I don't know that just doesn't strike me as normal for a contract.

And the party who is bound by the contract does not have a copy. I think this is ACC/ESPN way of making legal scrutiny and discussion of the contract almost impossible or at least very expensive, especially if you can't copy any part of the contract. That should have raised red flags long ago. Any ACC member that thinks that is ok needs to be kicked to the curb for being so dumb.

Even the US Bill of Rights had multiple copies, one for the federal government and one for each of the original states so we'd know what we signed up for.

Can they deny a FOIA request?

Seems like there may be some violation of contract law if they refuse a copy to a party of said contract.

They obviously didn't deny a request if the schools saw it earlier this year.

Foia is for government info. This is a private contract.

The emphasis at that time was the biggest threat to the ACC

was teams jumping. But because the ACC has been terrible on the field and/or in the stands (except one team most years) since it was signed... the contract ended up being a mutual suicide pact.

Had more ACC programs preformed better on the field then it would have been hailed as a good move to keep people from bolting.

FSU getting left out was absolutely insane.... but now that the playoffs have 12 teams the ACC path to the playoff is secured again. FSU is being stupid.

badge-donor-10yr.jpg flag link military_tech thumb_downthumb_up

I honestly think FSU's lawsuit is less about being left out...

this year and more the 30+ million operating deficit they'll be operating at in the current ACC scheme for the next *checks notes* THIRTEEN?!?!? years.

It's just not tenable for FSU to be making that much less than, say, Vanderbilt every year. Especially now that you can legitimately buy players.

If this GOR stands... there likely won't be a major ACC football power in '36.

flag link military_tech thumb_downthumb_up

If FSU pays out $300-$400 million to leave... we would get a nice chunk of money

Dec 23, 2023, 9:21 AM

That's an extra $10-15 million for us probably. That will buy a new offense. lol

badge-donor-10yr.jpg flag link military_tech thumb_downthumb_up

that's short term thinking...

1

let us say that FSU pays out the estimated 500 million all at once (which we know they won't), and let us say that ALL of that money goes to the remaining teams (which again... we know it won't).

500 million/16 teams (assuming we count SMU/Cal/Stanford) = 31.25 million ONE time payment.

Even if you don't include the new teams it only jumps to 38 or so million. Again, one year of that.
That's the operational spread the SEC/Big10 have EVERY YEAR going forward on us.

It's just not tenable moving forward if you want to have a championship level football team to stay in the ACC if this GOR stands.

flag link military_tech thumb_downthumb_up

It might be short-term thinking to leave... as the playoffs

move to 12 teams. And conferences are probably about to dissolve as well.

Lets say in 5 years the ACC dissolves anyway because of a reorganization. FSU spent all that money for nothing.

Clemson is not going to fall down a drain or get sucked into a black hole.

I love that we are sitting quietly just waiting while FSU is freaking out.

expanding the playoffs helps.

Granted FSU would have gotten in this year if we had 12 spots. So?
The 12 team playoff looks to be dominated by the Big 10 and SEC, so any money argument you make about getting more ACC teams in is swallowed up by the greater amount of money those two conferences will get. At BEST the ACC would get two teams in per year. Versus what? 3 minimum for each of those conferences?

This makes the money differential WORSE, not better.

And I'm highly dubious that all the conferences are about to dissolve. Too many long term contracts and too much money tied up in the current system for them to say 'you know what, toss this whole thing and start over'. That's a hope and a prayer at BEST.

History is littered with teams/sports etc... that thought 'nothing bad will happen to US!' and didn't make aggressive changes when needed. Let's hope that's not our administration's approach.

WADR, you are looking T the wrong thing. Regardless of where the contract is currently kept, we have to assume the leaders of each school who signed the contract in 2016 read it and were in agreement before signing said contract. The current location is immaterial.

I agree but it’s also why it’s essential that ancillary communications between the conference, the schools, and ESPN go through discovery because if the schools were deliberately misled about the terms being negotiated with ESPN (which terms necessitated the GOR) then you would have cause to sever. Even if ESPN was forthright about their intentions and the ACC University Presidents actually signed such a one-sided agreement you MIGHT have a claim for negligence that could nullify the GOR. These school presidents are not media rights experts and agreed to a clearly inequitable arrangement. The majority of these school Presidents are ultimately public/State employees and those states often have severe limitations on civil damages. If FSU can prevail with Florida as their venue, which they probably will as their state law regarding the employee who executed the contract on FSU’s behalf should prevail over the ACC’s contract language. But this is a fairly simplistic breakdown and there are a ton of variable in play.

The problem is, all this stuff you are saying is being pulled out of thin air. What people keep ignoring is that the SEC has a similar contract that runs through 2034. I hate to tell you, but this is simply not going to work.

It’s not pulling out of thin air that one conference has been relegated to Friday night games - a known dead zone for tv ratings. It was a conflict of interest for them to claim to be able to represent the best interest of two competing entities. The NCAA lost the argument when their control of tv rights was tried. They lost their control over players on multiple fronts. To believe that ESPN’s behavior could be viewed as monopolistic is not some giant leap. Now add state interest in all these public schools - that they are now provoking rather than benefitting - and it’s a recipe for disaster for ESPN. Are you gonna argue Disney/ABC/ESPN have been make wise decisions beneficial to shareholders?

So are you saying the ACC was deliberatly trying to hide the 2027/2036 clause from the member schools by making this "read it in person" rule? If so, then I agree with the this twitter post. This is probably a really good chink in the armor of this GOR "agreement"?

Any school can leave the SEC any time they want. No school is bound by a 'hostage' agreement. No one wants to leave. It is a conference where everyone pulls together.

I hate to see where college football has landed. It has came down to a bidding war and I don't see how it can survive like that. FSU knows if they are locked in for a long, long time in the ACC, with the current state of what it takes to obtain athletes, they will be a has been soon.

Any contract I’ve ever been associated with both sides got an executed copy. To me the lawyers for the individual schools were at fault for advising\allowing this to happen.
