Team wanted to leave the conference now the 50 mil exit fee could be negotiated once lawyers got involved. Wouldn't voting on the 50 mil make it almost impossible to get out of?

I think the commitment was worth more than 50 million. It's priceless for those who signed it.

If Clemson or FSU wanted to go to the Big 12 and they wanted one or both of us the money would be the least of the problem.

it is negotiable, and anyone leaving the ACC would not be paying $50 mil.

The thing that is not negotiable is an "Grant of Rights". If everyone in the ACC was happy with the deal, then why not sign a GOR for "x" amount of years?

One is not more concrete than the other.

One of the reasons no GOR was signed is because it is tied into the TV contract. The ACC TV contract will be revisited with the addition of ND.

A GOR specifically says... "we own your TV rights if you leave".... hence "granting the rights".

An exit fee is paid and it's done

"wiggle room" in a GOR... simply b/c you have agreed to turn your TV rights over.

For example, the ACC knows they will continue to make money, so they will not negotiate. (unless it's huge)

is a mass mutiny the ACC would hold fast to the $50 million buy-out. I doubt it was more than a coincidence that the deal was announced along with the new buy-out. Then again, I doubt the ACC would want a long, drawn-out battle with adverse publicity, so that would probably allow for some "wiggle" room.

I actually think the entire thing was designed to get a firm commitment from ND and discourage them from entertaining other offers. In turn we made a commitment to them to become stable after the 'talk,' this past six months.
