All this yapping from a few about its best to stay in the ACC or there isn't any way we can get out of the GOR, etc, etc, etc....... The Clemson leadership doesn't feel this way...AT ALL.
Listen to Dabo in this instance.......he's 1000% correct.

But I do think they feel that their only option is to try.
We agreed to a horrible deal in the first place. It was dumb then, and it looks even worse now. Hopefully we will learn from this and never tie ourselves to a conference again, even if it’s in the name of “conference unity.”
It seems that at some point, Clemson’s leaders failed to prioritize Clemson’s best interest. Now we are paying for it, and they are trying to fix it.

It was not a dumb deal, unless the president of Clemson is liar...he is not...it was a much better deal than we were getting before...only became a bad deal when the SEC and BIG whatever got better deals when you mischaracterize what we said when the deal was done you are committing fraud...we were tickled to make more money...have not seen a single report from CCC in 2014 that we were upset with a bad deal! Good then, bad now, us and the semiholes...ACC is not the SEC or BIG and probably never will be...certainly not if we leave...I doubt if Dabo is happy!

It has to be the B1G. If reading the petition correctly, Section 42 specifically asks the court to confirm the GoR is effectively a media agreement with the schools, ACC, and ESPN. In theory, having the court rule in favor of Clemson on these clarifications allows us to leave for the B1G without having to pay media rights to ESPN following the exit.

It’s just like when George Lucas sold the toy rights to Star Wars to Hasbro. (Dumbest move in history). The board of trustees signed a contract selling their media rights to our sporting events. It’s sellers remorse. Courts almost always (99.999%) of the time side with the purchaser of rights. I think the best case scenario is a renegotiation of revenue paid. Worst case scenario is we leave and commit financial suicide through 2036. It would be hard to field any sport without that money.
I hope and pray I’m wrong. I kinda hope the ACC can straighten this mess out and get our members the money they deserve. ESPN controls the purse strings and they want to destroy every conference not named the SEC. They have all their eggs in that basket and it’s what we’re really fighting against.

JEDI: ACC screwed up. You think CLEM files w/o having all its stuff together??? That will come out. The ACC is NOT a good partner. CLEM will have other $$$ coming in from new conference.
Give CLEM admin a bit more credit.....

After a cursory reading of the complaint, it reads like "contracts shouldn't be enforceable."
Not sure that's a real compelling legal argument, but Nelson Mullins and Ropes & Gray have talented lawyers so we shall see how that works out for them.

To me it's less "shouldn't be enforceable" as much as it is Clemson saying their interpretation of the contract differs. Clemson agrees there would be some type of penalty to leaving, but wants the court to confirm if the ACC has the "iron clad" claim to $140M they think they do, or if it's a smaller amount for home games played on ESPN while in the ACC.

but not in this day and age when we have a supreme court justice stating, outloud and in court, that the First Amendment may be hamstringing the federal government. When a woman claims that someone, a prominent past president raped her, is called a liar by the accused and the accused is found guilty in a civil trial, fined millions of dollars and the accused was never even charged with the crime. At least OJ was charged with murder.
In this day and age just find a willing judge and jury and you can get anything tossed or contracts broken. JMO

From my understanding, which I fully understand I can be wrong:
When contracts are signed and there is ambiguity, the law states that the person(s) who did not draft the contract, are in fact protected.
With Clemson defining that, to their understanding (creating ambiguity), of the media rights not existing after a member's exit, the courts must consider that while all ACC schools signed the contract, those signatures were made in with the understanding of each individu institution.
If there is language that is unclear as to the rights of the media after a school is no longer part of the conference, the courts would be pushed to support Clemson and any other school using this argument.
FSU's argument was that it was "unfair". While Clemson has pointed out the disparity and the hardhsips it will cause, they have specifically pointed out what they see as a vulnerable point in the clause.
Living in the America we do know, where the courts decide to let killers go free and seek lawsuits against people for sneezing in the wrong direction, I do not have much hope that we will win this lawsuit, but I pray that the schools diligence, patience and long-term diacovery will put Clemson in a better position.
Regardless of what happens, Clemson will come out of this and return to national prominence one way or the other. We have Dabo and God on our side. God can't possibly be a fan of the courts, espn, or the evilness that is the ncaa.

I’m simply concerned that we’ve waited too long to take action. Our stock was higher a few years ago when these agreements were being drawn up. Since then, the two major conferences have been sweeping up good teams. We might be seen as desperate at this point. However , we need to exit the ACC. Financially, and status -wise, it’s past time to go.
