in 2024, but the dems control the house and the senate, the precedent is being set for her to send a group of peaceful protesters to the capitol to fight like hell and save our country by preventing Congress from validating the electoral college results.

Note that on the evening of 1/6/21, large majority of GOP house members did not vote to approve the 2020 electoral college. This vote went on party lines. If the GOP controlled the house along w the senate, trump might still be in the White House.

So unless this impeachment and conviction makes it clear that attempted coups are not an option for future POTUS, the door will be open for future POTUS to steamroll the legislative branch and remain in power by truly stealing an election.

So forget separation of powers, the current 44 GOP Senators are weakening the house and senate, strengthening the executive branch and opening the door for nutcase POTUS in the future to effectively enact coups.

Also note, state governors can run thru this open door and deploy state level coups based on the current precedents being set.

There is no longer any question trump will be seen (by sane people) as the worst president ever.

Let me take this point by point.

I am not sure that you fully understand plenary power or how it applies in this case.

These processes ARE laid out in the Constitution. I think that our problem lies with the fact that so many Republicans sought to exercise those Constitutional powers with absolutely NO EVIDENCE of voting improprieties. They abused those powers and Big House is pointing out the danger of the precedent that creates for the future. This is NOT an example of checks and balances. In another set of circumstances, the Republicans in the House proved themselves willing to throw out the results of a legal election.

The Constitution does not say anything about impeaching someone after they have left office. In fact, Trump was impeached while still IN office and now the Senate is fulfilling their obligation to try the impeachment charges brought by the House. There is even a precedent where Secretary of War Belknap was impeached after resigning.


The Constitution does not say anything about the Judiciary presiding over ALL cases of impeachment. It does mention it in cases involving a sitting President because the VP (President of the Senate) would have a conflict of interest in such a case.

After that you get off on a tangent about other stuff that the Dems are doing that you don't like. Which is really what your whole post is about - not Constitutionality but just stuff you don't like.

Dems will lose the House in 2022. And once again no one will give credit to Trump for many good things he accomplished. As long as cowardly Jimmy Carter is still a previous US president, Trump will never be the worst US president.
