Before you give your soul and common sense to a corrupt politician (pick one) or a corrupt political party (pick one) or a corrupt social ideology (pick one), perhaps you should consider THIS little tidbit of info.

If cases don't continue to decline, or there is a second wave because people insist on their right to "live as they please" regardless of the consequences for others, including their own extended families, there WON'T be a College Football Season this year. Period.

As a health care guy I'm surprised that you kinda missed the whole point of flattening the curve and the stats that are now apparent.

Here ya go: The flattening was an attempt to reach a point at which the number of cases was declining and, more importantly, hospitals were NOT being overrun (ie. people could be treated quickly and in a timely fashion). WE are now at that point, and Sweden was never close to having their hospitals too full to treat COVID infected patients.

Did you forget that over 99+% of infectees will recover from the virus? And the experts estimate that we will kill many more Americans than the virus IF we don't reopen the country. Lack of routine medical care, chemo, cancer diagnoses, suicides, depression, lack of interaction and so forth.

Again, Felix...try harder to not embarrass yourself, although we do enjoy your 'socialist comedy'. So, as they say, you're not useless, you can always be used as a bad example...or, of course....a comedian.

Stay safe brother, but stay away from the MSM. They're more dangerous than the COVID!!

27 out of 100000 is .00027 so that's your probability of death. A risk many are willing to take. You have to weigh your own propensity for that risk. I am on the side of if you want to take that risk take it. If not, mask up/isolate/hide.

Then around a 0.1% chance of dying if you get it if young and healthy, so 0.08% and still low. After 40, that probability increases and then increases a lot more rapidly after 60. These numbers are from memory and 80 is from the herd immunity theory, which requires a slow spread rate.

It will be a long time before we have the real numbers. CDC guidance last week said nursing homes weren’t required to report covid deaths prior to 5/8, an attempt to delay passing the 100k number until after memorial day.

the penetration predictions. The rate is how fast the contagion spreads, penetration is how many people it eventually infects. Without a vaccine or a natural die-out of the virus from extreme mitigation, they expect eventual penetration at 80% or above. For reference, H1N1-pdm09 is still infecting and killing people 10 years later.

An old professor of mine once stated very accurately that there are no "rights", as the writers of the Constitution meant to imply, but only "privileges". "Privilege: a benefit, immunity, etc, granted under certain conditions." Our constitution takes great pains to delimit those "conditions", and does so very carefully under the judicial branch of the government which it defined, and which we still live by - at least for the time being. I hate to think it's taken us 36 years to reach 1984, but here we are. Nolo contendere....

The fact the media have people like you all up in a frenzy is a shame. Hiding from a virus never works and never will. This was about not overrunning the hospitals we did so why are we still here? It's political now, period. If everyone would have gotten the heck out of the way we would have reached herd immunity and been done with it for the most part. I have a belief that there is a place far greater than this earth waiting on us. Therefore what becomes of this body on this earth is of little consequence in the grand scheme of things. They feel like they don't want to be told what to do no matter how smart the advice is. And I can promise A LOT of people on this board feel that the gov't violates their rights by telling them to do something smart for society.

It is precisely because people don't want to shelter at home. My kids shouldn't have to stay in the house, my parents, etc. Particularly in view of the CDC saying this weeks that approx. 35% of covid-19 infected are asymptomatic. As purely a public health matter, to protect others from being infected is the minimum we should expect from the people who say they 'love America' so much. America is people, it's not some abstract theory.

Agreed Judge. But you use whatever means necessary to get these idiots to think about others kids, parents and grandkids instead of themselves. Facts or common sense don't seem to work, thought football might breakthrough.

I find it odd that some of the same people who are screaming about being 'forced' into protecting their own lives as well as the lives of their families are the very same people who are outraged that gay people should have a right to marry whoever they like. "The rules are for thee, not me."

I kinda think the GAY thing is mostly beyond most of Western society at this point. Its basically do whatever you want. Also, I’m not sure you should equate those who strongly disagree with you in this discussion on lockdown as those who may be opposed to Gay marriage. There are a lot of free thinkers on this board. However, the big takeaway here is that I find it extremely hypocritical for someone who has strong views on individual choices in reference to Gay lifestyle but cant understand or respect those who value individual choices in relation to this discussion on lockdown ########. Again.. no need for the term Idiot. You have the freedom to stay home and shelter in place. You should respect and understand those who choose differently.

much besides defense and infrastructure. I’ve never understood the anger people have about gay people getting married. The government shouldn’t be involved in marriage. It should be a private thing between two consenting adults. My own heterosexual and Christian beliefs shouldn’t prevent a gay couple from being able to marry.

I will say that this COVID situation has been one that has been tough at times from a libertarian perspective. While I don’t like the idea of the government telling individuals and private business owners what to do, I certainly understand the importance of public health and the government’s desire to minimize illness and fatalities from the virus. Especially since the government is heavily involved in healthcare (I don’t think they should be, but they are, and that gives them a lot of skin in the game when it comes to this pandemic).

How long should we shelter at home? Until there are zero new infections? Until there are zero deaths? Until there are zero hospitalizations? Until there is a proven vaccine? Since flattening the curve to prevent overwhelming the hospitals is no longer the goal - please explain what the goal is and the specific metric that will result in lifting the "shelter at home" dictate.

While waiting for whatever metric you deem appropriate - what do you propose we do to support the half of the country that's not allowed to go to work while sheltering at home? Does our Government continue to pass $4 trillion spending bills every month to provide people with money to survive and keeping some businesses from permanently disappearing? How long do you think the Government can keep doing that before inflation kills our currency from printing this money or the debt from borrowing results in the crumbling of our society?

It's awful easy for some folks who are still getting paid while sheltering at home to tell others who are struggling, going bankrupt, or losing their "non-essential" business to just "shut up and stay at home." The old saying "Don’t judge a man until you have walked a mile in his shoes" comes to mind. If no one (especially politicians and government employees) was getting paid during this crisis I have a feeling there would be a lot more folks clamoring for their rights then just us "idiots"...

Mostly common sense and would work perfectly in almost any other country.

We have a problem with an extreme 15-20% who, despite being too illiterate to understand the Constitution, believe that they have the right to go anywhere, do anything at the expense of everybody else. They won’t wear masks or do any simple thing to prevent infecting other people, because that infringes on their rights. Many carry concealed weapons into the post office because of a mistaken belief that the 2nd protects them from that felony.

Most of that 15-20% also doesn’t pay a dime in federal income tax. Not a dime.

I agree that the simplest Americans should not be allowed to set Federal policy. But don't they have a voice? Do you and Hillary have the right and obligation to ignore them because you consider them to be 'deplorable?'

What about this oversimplified 'no federal income tax' claim: are you saying they don't pay the legal 7.65% FICA tax that the government plays shell games with? Or those who are self-employed the full 15.3%? I guess you aren't. Your kind likes to mock the low-wage worker, not the person sitting at home not even contributing to the system.

Do you deny these Deplorables pay state and local taxes? Do you deny that every product they purchase costs 10-33% more than it would if not for income taxes on the high-wage person who made it? What about gasoline taxes? Taxes on phone bills? Electric and gas bills? 'Not paying a dime in federal taxes' doesn't mean they are entirely living off the public teat.

Yet there are millions of Americans living entirely off the public teat, and we are not attempting to isolate them politically in this discussion. So long as they are citizens, i believe they have a right to be heard.

So why are you trying to divide the American public into segments that are easier to marginalize?

Pretty straightforward. No, FIT does not include FICA, state income tax, real estate tax, local tax or school tax.

Yearly, just over 50% pay some FIT. (53% last year). This year with the extra tax credits, less than half of Americans will pay some FIT. I think I pay too much because of this, and the latest tax “cuts” only made it worse by limiting deductions and changes to AMT recovery and the NIIT. I have no problem with refundable credits for people raising children, caring for relatives or the disabled. Otherwise everyone else should pay something, even if it’s $10.

My argument is with the 15-20% who want to trample on everybody else’s rights for their own perceived freedoms. That includes the white supremacists, neo-Nazis, and neo-Confederates and their sympathizers who constitute up to 15% of that number. Think of all the people you know who made excuses for the Charlottesville marchers - that’s them.

Felix, if you really think you are talking to the 900+ people who attended the party in Union Co, I'll agree with you. Those people are so irresponsible that they have a short life expectancy anyway.

But you aren't. You're talking to Tigernet, one of the most responsible forums anywhere, in spite of the fact that we are 100% composed of flawed individuals, and that includes both you and me.

So, in the interest of discussion rather than diatribe, which "rights" should a responsible community be willing to give up in the face of a pandemic? For how long? And who decides when we get them back ? IF we get them back?

And since you have set yourself up to be the spokesman for the new community-based morality, what have you done with the old morality? Will it ever be relevant again? Does God, in whatever form we call Him, only exist in non pandemic times?

See, regardless of how we tend to corrupt all of our social ideologies, they are still relevant to us. Coronavirus didn't kill God, or the Constitution. Coronavirus hasn't changed my love for my family, my friends and even some for Tigernet. In times of great anxiety and stress, the ideas we believe in become MORE important, not less.

If we give up those ideas when life gets difficult, we cheapen them. They aren't real to us. They are luxuries secondary to survival. Well, some of us don't want survival without them. Those ideas have created and sustained entire cultures for thousands of years. And today we celebrate those who gave their lives defending those ideas--sorry, those "rights"--for the rest of us.

If I don't want to catch a contagious virus, it is my responsibility, not yours, to protect myself by whatever means are resonable and necessary. It is incumbent upon you not to, through unreasonable negligence or malicious intent, infect me. Going to work, walking down the sidewalk, going to the park or a restaraunt, is neither negligent or malicious.

It's as if common sense has gone out the window.

YOUR RESPONSIBILITIES AND OBLIGATIONS TO OTHERS: Don't cough or sneeze on other people. Don't get up in people's faces. Keep a reasonable distance whenever possible, UNLESS the other person/people has consented otherwise. If your job requires close contact (hair stylists, doctors, etc.), wear a mask. If you are sick, stay home. If you are not isolating at home, stay away from old people and people with medical conditions.

YOUR RESPONSIBILITIES TO PROTECT YOURSELF: Wash and sanitize your hands frequently. Keep a reasonable distance from other people as much as possible. If you go into a crowded situation (concert, football game, mosh pit, etc.), know that you can have no expectation for social distancing, and that you are accepting full responsibility for the consequenses. Know that anytime you go out in public, you are incurring some degree of risk. If you are old or have a medical condition, stay home and isolate; don't let your kids or grandkids who are not isolating come over; if you don't, you can have no expectation of protection from the virus.

Open things back up. Go to work. Go to baseball games, races, football games, restaraunts, beaches, parks, shopping, etc., but know you are taking a risk, and that you could get sick, or become a carrier of the disease. Becoming infected in such a way is your choice, and your right. Passing it along to other people who are isolating, is not your right, and it violates theirs.

Our economy cannot withstand a prolonged shutdown, not withouit dire consequences that will result in the suffereing of millions, particularly the most vulnerable. Remaining on any kind of shutdown is simply not an option, and is not only misguided, but arrogant, cruel, and short-sighted.

THE COURT: All right. This court has reviewed the plaintiff's complaint, including attachments, prior to today's hearing. The court has had an opportunity to review the response submitted by the defendant and attachments and case law. Before I rule, I'm advising everybody in this room, no public outbursts or displays. The court is still in session until you are told otherwise.

Since the inception of this insanity, the following regulations, rules or consequences have
occurred: I won't get COVID if I get an abortion but I will get COVID if I get a colonoscopy. Selling pot is essential but selling goods and services at a family-owned business is not. Pot wasn't even legal and pot dispensaries didn't even exist in this state until five months ago and, in that five months, they have become essential but a family-owned business in existence for five generations is not.

A family of six can pile in their car and drive to Carlyle Lake without contracting COVID but, if they all get in the same boat, they will. We are told that kids rarely contract the virus and sunlight kills it, but summer youth programs, sports programs are cancelled. Four people can drive to the golf course and not get COVID but, if they play in a foursome, they will. If I go to Walmart, I won't get COVID but, if I go to church, I will. Murderers are released from custody while small business owners are threatened with arrest if they have the audacity to attempt to feed their families.

These are just a few of examples of rules, regulations and consequences that are arbitrary,
capricious, and completely devoid of anything even remotely approaching common sense.

State's attorneys in this state, county sheriffs, mayors, city councils and county boards have
openly and publicly defied these orders followed by threats to withhold funding and revocation of necessary licenses and certifications unless you obey.

Our economy is shut down because of a flu virus with a 98 percent plus survival rate. Doctors and
experts say different things weekly. The defendant cites models in his opposition. The only thing experts will agree on is that all models are wrong and some are useful. The Centers for Disease Control now says the virus is not easily spread on surfaces.

The defendant in this case orders you to stay home and pronounces that, if you leave the state, you are putting people in danger, but his family members traveled to Florida and Wisconsin because he deems such travel essential. One initial rationale why the rules don't apply to him is that his family farm had animals that needed fed. Try selling that argument to farmers who have had to slaughter their herds because of disruption in the supply chain.

When laws do not apply to those who make them, people are not being governed, they are being ruled. Make no mistake, these executive orders are not laws. They are royal decrees. Illinois citizens are not being governed, they are being ruled. The last time I checked Illinois citizens are also Americans and Americans don't get ruled. The last time a monarch tried to rule Americans, a shot was fired that was heard around the world. That day led to the birth of a nation
consensually governed based upon a document which ensures that on this day in this, any American courtroom tyrannical despotism will always lose and liberty, freedom and the constitution will always win.


That said, plaintiff, your request for a TRO with respect to Count I is denied. Your request for the TRO on behalf of similarly situated individuals is denied. If you develop some other case law or ability to convince me that that appellate court opinion you cite trumps current civil practice rules, I'll be glad to consider it later. Counts II and III are granted to
your client only.
